Milkes, Esquire, JACOBSEN & MILKES, and state as follows: 1. The Plaintiffs are adult individuals residing at 111 East Factory Street, Mechanicsburg, Cumberland County, PA 17055. 2. The Defendant, JULIO SANCHEZ, is an adult individual residing at 1 North Pitt Street, Carlisle, Cumberland County, P A 17013. 3. The Defendant, MIGEL A SANCHEZ, is a minor individual (believed and therefore averred to be sixteen years of age) residing at 1 North Pitt Street, Carlisle, Cumberland County, PA 17013. 4. The Defendant, American International Group, is the automobile insurance carrier for one or more of the other named Defendants. 5. Judgment was entered against the American International Group by District Justice Gayle A. Elder in connection with the disputes addressed in this Complaint and this Defendant appealed the judgment at Docket No. 00-5516. 6. Judgment was entered against JULIO SANCHEZ by District Justice Gayle A. ,,~t-> ~'~ ' - ''"-''. ~... '.. ".' The Defendant, American International Group has an obligation to honor valid claims raised by persons who suffer harm from this Defendant's insureds, under the circumstances set forth in this Complaint. 8. The Notice of Appeal Filed in this case was filed by the American International Group. 9. Plaintiffs believe and therefore aver that JULIO SANCHEZ is the Uncle of MIGEL A SANCHEZ. 10. Plaintiffs believe and therefore aver that JANE DOE SANCHEZ is the Aunt ofMIGELA SANCHEZ. 1l.Plaintiffs believe and therefore aver that JULIO SANCHEZ and JANE DOE SANCHEZ were acting, at all relevant times to this action, in a parental roll, as Guardians, and in loco parentis to the their nephew, MIGEL A SANCHEZ. 12. On or about May 26, 2000, the Plaintiff, WILLIAM FONTAINE, was driving a 1991 Pontiac automobile titled in the name of his wife, LINDA FONTAINE. 13. On this date, WILLIAM FONTAINE drove to a gas station located at 105 North Walnut Street, Mechanicsburg, Pennsylvania, for the purpose of filling the vehicle with gas. 14. On this date, MIGEL A SANCHEZ was also operating a vehicle, a 1985 Oldsmobile Cutlass Supreme, titled in the name of JULIO SANCHEZ. 15. On this date, MIGEL A SANCHEZ backed his vehicle into the Plaintiffs' vehicle. ,"--, , . '~~.., - , ,." " ,~', " ~ i ,,'~, , ,,~ ' ; ,~, ~.' '~"'" ',",,""'" ~, , ~, ",-,,' ;':~,~ ''':c_/'':', ';','. ' ", _'",~, ,;.,;t>~ 16. This incident occurred at a time that Plaintiffs' vehicle was unoccupied and parked in a permitted and appropriate parking spot. 17. MIGEL A SANCHEZ was issued a citation by the Mechanicsburg Police Department for Careless Driving in connection with this incident. 18. The collision which occurred was the fault of MIGEL A SANCHEZ and involved no fault of WILLIAM FONTAINE. 19. The collision resulted in damages to Plaintiffs' vehicle in the total amount of Two thousand one hundred forty-seven and no hundredths ($2,147.00) Dollars. 20. The collision resulted in other out-of-pocket expenses as a result of the automobile having to be repaired. 21. The Defendant, MIGEL A SANCHEZ, upon being interviewed by police officers at the scene and upon being interviewed by a bi-lingual police officer stated that: a. MIGEL A SANCHEZ did not have a valid drivers license. b. MIGEL A SANCHEZ was in the United States illegally. c. MIGEL A SANCHEZ did not speak English. d. MIGEL A SANCHEZ had permission from JULIO SANCHEZ to drive the vehicle on that day. e. MIGEL A SANCHEZ had dropped his Uncle, JULIO SANCHEZ, off at work that day, using the same vehicle. 22. While JULIO SANCHEZ now apparently claims that the car was stolen by MIGEL A SANCHEZ, he never reported the car stolen and JANE DOE SANCHEZ led police to understand that MIGUEL SANCHEZ had permission to dive the car. 23.
