WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Fernwood Avenue,
Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to
execute contemporaneously herewith, a contract, with Glenn Snider, Jr., and Glen Miller,
t/d/b/a SNIDER-MILLER BUll.DERS, for the erection of a house ancillary to development in
a complex known as Wertz Run Heights, Phase III, Cumberland County, Pennsylvania,
construction described as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot No. 35 of North
Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and
described as set forth in Exhibit "),:' attached hereto and made a part hereof
NOW, this 15th day of August. 2000, at the time of and immediately before
the execution of the principal contract dated August 15 , 2000, and before any authority has
been given by the said Owner, to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the marking of the said contract with Owner,
and the further consideration of One Dollar and 001100 ($1.00), to Contractor paid by Owner, it
is agreed that no lien shall be rued against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.

All that certain tract ofland located in North Middleton Township, Cumberland
County, Pennsylvania, being Lot No. 35 Phase 3 Wertz Run Heights, bounded and
described as follows, to wit:
Beginning at a point on the southern right~of-way line of Meade Drive (a 50.00'
right-of-way), at the line of Lot No. 34, said point being located the following two
courses from the terminus of a curve, connecting Meade Drive to the western right-moo
way line of Longstreet Drive; 1) North fifty-two degrees, forty-five minutes, zero seconds
West (N 520 45' 00" W) a distance of one hundred five and eighty-two hundredth feet
(105.82') 2) by a curve to the right, having a radius of two hundred twenty-five feet
(R=225.00'), an arc distance of one hundred seventy-one and ninety-six hundredth feet
(A/L=171.96') thence from said point of Beginning, by Lot No. 34 South eighty-one
degrees, two minutes, thirty seconds West (S 81002' 30" W) a distance of three hundred
sixteen and eighty-eight hundredth feet (316.88') to a point; thence by land now or late of
Charles F. and Ruth A. Hoy North thirty-seven degrees, fifteen minutes, zero seconds
East (N 37. 15' 00" E) a distance of two hundred twenty-one and seventy-four hundredth
feet (221.74') to a point; thence by Lot No. 36 . South seventy-seven degrees, three
minutes, forty-five seconds East (S 770 03' 45" E) a distance of one hundred eighty-six
and forty-nine hundredth feet (186.49') to a point on the southern right-of-way line of
Meade Drive; thence by said southern right-of-way line, by a curve to the left, having a
radius of two hundred twenty-five feet (R=225.00'), an arc distance of eighty-five and
ninety-eight hundredth feet (A/L=85.98') to a point, the place of Beginning. Said tract
contains 31,903.48 sq, ft. or 0.7324 acres.
