[XX] 5. Pending the outcome of the final hearing in this matter, the current custody order
shall remain in effect with the following modification: The custodial exchanges of the children
Isaac J. Maswadeh, born June 1, 1997, and Alexus Nor Maswadeh, born July 17, 1998, shall take
place in the parking lot of the North Middleton Police Department located at 2051 Spring Road,
Carlisle, P A 17013. The Custody order is attached as Exhibit A.
[XX] 6. Defendant shall immediately relinquish the following weapons to the Sheriff's
Office or a designated local law enforcement agency for delivery to the Sheriff's office: All
Hunting Knives, Butcher Knives, Pocket Knives, Unregistered Handguns, Registered Handguns
and Shotguns. Possible weapons may include a .38 caliber pistol, a rifle and a shotgun, all of
which were relinquished to the sheriff s office as a result of a 1997 Protection From Abuse Order
(No. 97-2887).
Defendant is prohibited from possessing, transferring or acquiring any other weapons for
the duration of this order.

NOTICE TO THE DEFENDANT
Defendant is hereby notified that violation of this Order may result in arrest for indirect
criminal contempt, which is punishable by a fine of up to $1,000.00 and/or up to six months in
jail. 23 Pa.C.S. 9 6114. Consent of the Plaintiff to Defendant's return to the residence shall not
invalidate this Order, which can only be changed or modified through the filing of appropriate
court papers for that purpose. 23 Pa.C.S. 96113. Defendant is further notified that violation of
this Order may subject himlher to state charges and penalties under the Pennsylvania Crimes
Code and to federal charges and penalties under the Violence Against Women Act, 18 U.S.C. 99
2261-2262.

Both plaintiff and defendant have shared legal custody. The plaintiff has primary
physical custody. The defendant has periods of partial custody as follows: The defendant has
partial physical custody of the minor children on all days when the plaintiff is at work. The
defendant picks the children up a half hour prior to plaintiffleaving for work, usually 2:30 p.m.
or 3:30 p.m., and the defendant drops the children off at 7:30 p.m.

Describe in detail what happened, including any physical or sexual abuse, threats, injury,
incidents of stalking medical treatment sought, and/or calls to law enforcement:
At 11 p.m. on the evening of August 30, 2000, the defendant was to bring the children to
the custody exchange drop-off point, which is the entrance to the Middleton Development, where
Plaintifflives. The plaintiff works across the street from the drop-off point at the Turkey Hill gas
station. Plaintiff finishes work at 11 p.m. At approximately 10:30 p.m., defendant arrived and
parked his vehicle along the road across from Turkey Hill. Defendant sat in his car and watched
plaintifffor a short period oftime and then made a V-turn through the Turkey Hill parking lot.
Defendant has been banned from the Turkey Hill premises, so plaintiff contacted the North

Middleton Police Department. The police department told plaintiff that there was nothing they
could do. The defendant then parked his car at the entrance to the Middleton development to
wait for plaintiff to get off work. At approximately 11 p.m., plaintiff walked across the street to
the entrance of the development to pick up her children. As the plaintiff was walking toward
defendant's car, defendant got out of car and walked toward plaintiff and said "Did you call the
cops, bitch? Don't do it." Then defendant, using his closed fist, hit plaintiffs hand with a hard
blow. Plaintiff ran into her house, which is located in the development, to call the police. The
police arrived, and made defendant turn the children over to plaintiff and leave the development
area.
In the afternoon of August 28, 2000, the defendant picked the children up around 2:30
p.m., to take the oldest, Isaac, to a doctor's appointment. Later that day, the plaintiff went to a
friend's house. At approximately 6:30 p.m.; the defendant showed up at plaintiffs friend's
house with the children. Plaintiff and plaintiff s friend asked defendant to leave. At this time,
the defendant lifted his shirt and showed them a bulge in his pants pocket, which appeared to be
a gun. Defendant further stated that he would "put" plaintiff "in the cemetery." At this point,
plaintiff and plaintiff s friend went inside and called the police and said that they believed that
the defendant had a gun. Two police cars from the Middlesex police department, two police cars
from the North Middleton police department and two police cars from the Carlisle police
department arrived. Plaintiff and plaintiffs friend stayed inside the house during this time.
When a police office approached the house, plaintiff went outside to speak with the officer.
Defendant stated to the police officer that all he wanted to do was drop off the children. Plaintiff
agreed to take the children, but defendant would only drop the children off at the Middleton
development entrance. All parties involved, including all police officers, plaintiff, plaintiff s
friend and defendant, proceeded to go to the Middleton development entrance, where custody of
the children was exchanged.
13. If the Defendant has committed prior acts of abuse against Plaintiff or the minor children,
describe these prior incidents, including any threats, injuries, or incidents of stalking, and
indicate approximately when such acts of abuse occurred:
On several prior occasions, during the exchange of custody, the defendant has made
terroristic threats to the plaintiff. For example, defendant has threatened to "cut plaintiffs face
up so that no one would recognize her". Defendant has, on several occasions, carried a gun
when picking up or dropping off the children. Defendant, on several occasions, has followed
plaintiff around during the day, or has had someone else follow her around. Defendant also
verbally harasses plaintiff in front of children while exchanging custody of the children.
These acts of violence and threats are part of a continuing cycle. A Protection From
Abuse Order was issued against defendant in 1997 for his abuse of plaintiff. The abuse included
slapping, placing a gun against plaintiff s head and threatening to kill her, throwing plaintiff to
floor, hitting plaintiff with a belt and attempting to suffocate plaintiff.

without warrant, based solely on probable cause, whether or not the violation is committed in the
presence oflaw enforcement.
Subsequent to an arrest, the law enforcement officer shall seize all weapons used or

1. The Father, Arafat Maswadeh and the Mother, Valerie R. Ewideh,
shall have shared legal custody of Isaac Maswadeh, bom June 1, 1997, and
Alexus Nor Maswadeh, born July 17, 1998. rach parent shall have an equal
right, to be exercised jointly with the other parent, to malee all major
non-emergency decisions affecting the Children's general well-being
including, but not limited to, all decisions regarding their health,
education and religion.
2. The Mother shall have primary physical custody of the Children.
3. The Father shall have partial physical custody of the Children on
all days when the Mother is working from before the Mother leaves for work
as arranged by agreement of the parties until 7:30 p.m., unless agreed
otherwise by the parties. The parties' agreement to this partial custody
schedule for the Father is based Upal the Mother's current work schedule
under which she works at least 40 hours per week, usually frail 3:00 or 4:00
p.m. until 11:00 p.m. The Mother shall provide the Father with her work
schedule promptly upon receipt each week.
4. The parties shall malee custody arrangements for the Children on
holidays by agreement. The Father shall be entitled to have custody for a
3 hour period on each Child's birthday.
5. rach party shall be entitled to have uninterrupted custody of the
Children for up to 1, week during each SUlllller upon providing at least 2
weeks advance notice to the other party.
6. In the event either party intends to remove the Children from his
or her residence for an overnight period or longer, that party shall
provide the other party with an address and telephone number where the

AND NOW, this 5th day of December, 2000, after
hearing, the court finding that the defendant is in willful
contempt of the PFA order, sentence of the court on both counts,
jointly and severally, said sentences to run concurrent one with
the other, is that the defendant pay the costs of prosecution,
and undergo imprisonment in the Cumberland County Prison for a
period of not less than two nor more than six months. An
express requirement of parole will be that the defendant undergo
an assessment by the prison psychologist, Mark Zengerle, and
that he undertake and complete any recommended counseling.
This case shall be assigned to a probation officer for the
purpose of monitoring compliance herewith. The court will
consider work release. The defendant to receive credit for time

2. Defendant shall not abuse, harass, stalk or threaten Valerie Ewideh in any place
where she might be found.

any location, including but not limited to any contact at Plaintiff's school, business, or place of
employment. Defendant is specifically ordered to stay away from the following locations for the
duration of this Order: 11 Partridge Circle, Carlisle, P A (plaintiff' s home) and Turkey Hill, 1
Cranes Gap Road, Carlisle, P A (plaintiff's workplace).
4. Except for such contact relating to the minor child/ren as may be permitted under
Paragraph 5 of this Order, Defendant shall not contact Plaintiff by telephone or by any other
means, including through third persons.
5. The current custody order ofJune 1, 2000, Case No. 1997 - 3033, shall remain in
effect with the following modification: The custodial exchanges of the children Isaac J.
Maswadeh, born June 1, 1997, and Alexus Nor Maswadeh, born July 17, 1998, shall take place at
the North Middleton Police Department located at 2051 Spring Road, Carlisle, PA 17013. The
Custody order is attached as Exhibit A. If possible, the custodial exchanges shall take place inside
the police department. If the police department is closed, or the parties are unable to exchange
the children inside the police department, then the exchanges shall take place in the parking lot of
the North Middleton Police Department.

NOTICE TO LAW ENFORCEMENT OFFICIALS
The police who have jurisdiction over the plaintiffs residence OR any location where a
violation of this order occurs OR where the defendant may be located, shall enforce this order.
An arrest for violation of Paragraphs 2 through 6 of this order may be without warrant, based
solely on probable cause, whether or not the violation is committed in the presence of the police.

Subsequent to an arrest, the police officer shall seize all weapons used or threatened to be
used during the violation of the protection order or during prior incidents of abuse. The Police
Department shall maintain possession of the weapons until further order of this court. When the
defendant is placed under arrest for violation of the order, the defendant shall be taken to the
appropriate authority or authorities before whom defendant is to be arraigned. A "Complaint for
Indirect Criminal Contempt" shall then be completed and signed by the police officer OR the

party or COurt approval. Neither party shall remove the Children fran the
United States without the prior written consent of the other party or COurt
approval.
10. This Order is entered pursuant to an agreement of the parties at a
Custody Conciliation COnference. The parties may modify the provisions of
this Order by mutual consent. In the absence of mutual consent, the terms
