This action is brought in the Pennsylvania, Department of Corrections, S te Correctional Institution at Camp Hill, and avers the following in support of this Complaint: 2. Plaintiff is the Commonweal of Pennsylvania, Department of Corrections, State Correctional Institution at Camp Hill. 3. Plaintiff is an executive agenc of the Commonwealth of Pennsylvania responsible for administrating the state corre tional system including the State Correctional Institution at Camp Hill. 4. Defendant Carl Prince is an ilate presently incarcerated at the State Correctional Institution at Camp Hill. I I 5. Since September 5, 2000, Mr. Prince has missed thirty-three (33) meals. Between August 28,2000 and September 5, 2000, his weight declined from 126 to 121 pounds. 7. The above-mentioned refusal places this inmate at a great risk for his health; specifically, infections and heart and kidney problems in the next 24 to 48 hours. 8. It is the opinion of Dr. William Young that Mr. Prince is in imminent danger of the loss oflife or other irreparable hann unless medical treatment, including nutrition and hydration is administered on a routine basis. (See Affidavit of Dr. Young attached hereto as Exhibit "A" and made a part hereof). Mr. Prince may die or suffer other immediate and severe irreparable hann if medical treatment, including nutrition and hydration, is not administered to him as soon as possible. 9. It is impossible to predict the exact point at which Mr. Prince's condition may result in immediate, severe and irreparable hann; therefore, immediate medical intervention is necessary. 10. Permitting Mr. Prince to engage in a suicidal act by refusing nutrition and hydration will cause a significant disruption to the orderly administration of the State Correctional Institution at Camp Hill. The effects of his death would demoralize the staff and instill the belief in the inmate population that the prison administration caused and permitted Mr. Prince's death. I am a staff physician at the State Correctional Institution at Camp Hill. I am familiar with Carl Prince, who is an inmate at the State Correctional Institution at Camp Hill. 2. Since August 23, 2000, Prince has refused meals. As a result, his weight has declined substantially and he may be dehydrated. 3. As of September 5, 2000, Prince has refused 33 meals. June 1999, inmate Prince weighed 136 pounds. On August 28, 2000, inmate Prince weighed approximately 126 pounds, but as of today he weights 119 pounds. 4. Prince is a prisoner at the State Correctional Institution at Camp Hill, and is under the jurisdiction of the Pennsylvania Department of Corrections. The complaint avers that Prince was not eating properly and that he was in immediate danger of harm unless nutrition and hydration was undertaken. Ancillary to the complaint, the Department filed a petition for a preliminary injunction seeking to administer nutrition and hydration to Prince. Pursuant to Pa. Rule of Civil Procedure 1531 (a), an ex parte injunction was entered on September 5, 2000, that provided: 1. A hearing on the petition for a preliminary injunction was held two days later on September 7, 2000.2 A full transcript of the hearing is as follows: THE COURT: Was action taken on my temporary order? MR. ROBINSON: Yes, sir. THE COURT: The State is here asking that if you do not eat that they be allowed to provide you against your will nutrition and hydration. Are you opposed to that if you do not eat? THE DEFENDANT: No, sir. THE COURT: You are not opposed to it? You are not opposed to my entering an order that if you do not eat they can administer nutrition and hydration to you? THE DEFENDANT: No, sir. THE COURT: I am prepared to enter the order then and make the injunction permanent. MR. ROBINSON: I have no objection to that. THE COURT: Fine. Has he started eating since the action was taken? MR. ROBINSON: I believe he's had - A VOICE: He ate a box of cereal this morning. THE COURT: Okay. Good. I am going to enter the order. You are agreeable. Fine. Hopefully whatever the situation is that has brought this about you get yourself eating and hydrating again and you stay in good health. That is what my concern is here as a judge in the case. This is a civil action in equity. When Prince said that he was not opposed to the entry of an injunction "that if you do not eat they can administer nutrition and hydration to you," we entered an order to that effect. Otherwise, we would have conducted a hearing. There is no abuse of discretion in entering a preliminary injunction on the consent of the parties.
