NO LIEN AGREEMENT

WHEREAS, an agreement was entered into between:
Harold L. Bard 'CONTRACTOR' of 15795 Cumberland Highway, Newburg, PA 17240 and
Alan Cresswell and Catherine B'. Clay 'OWNERS' of 60 Hanna Road, Newburg, PA 17240
whereby the said contractor undertook and agreed to perform certain construction work and to provide
certain materials and perform certain work necessary to erect a dwelling for the price or sum of
$170,000.00 on owner's lot situated at Lot #2 Gilbert Road, Shippensburg, PA 17257.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH, That the said contractor for and in
consideration of the sum of One ($1.00) to him in hand paid by the said owners, the receipt whereof is
hereby acknowledged, and further consideration as agreed upon, for him, his sub-contractors and all partil3s
acting through or under him, by him, or any of them, against the said house of the owners situated as
above stated, and the plot of ground appurtenant thereto, for or on account of any work done or materials
furnished by him, or any of them, under said contract or otherwise, for towards, in or about the said
construction and work at the said house of the owners, and the said contractor for himself and his sub-
contractors, and others under him, hereby expressly waives and relinquishes the right to have, file or
maintain any mechanics' lien or claim against the said house and the plot of ground, and agrees that this
agreement waiving the right of lien shall be an independent contract.
IN WITNESS WHEREOF, the said contractor and the said owners have executed this agreement
August 11 th, 2000

ALL that certain lot of land, designated as Lot No. 2 situate,
lying and being in the Township of Southampton, County of Cumberland,
State of Pennsylvania, more particularly bounded and described in
accordance with subdivision plan entitled "Subdivision for John D.
Stoner" prepared by John R. Kissinger Surveying, which subdivision plan
has been approved as a final subdivision plan and is recorded in
Cumberland County Plan Book 81 Page 77, bounded and described as
follows:
BEGINNING at a set iron pin in line of lands now or formerly
of Bruce & Vera Whitmer, thence North 78 degrees 38 minutes
53 seconds East, 300.65 feet to a set iron pin in line of
Right~of-Way "A", thence along the right-of-way, South 6
degrees 42 minutes 7 seconds East, 531.67 feet to a set iron
pin at common corner of the within described lot and Lot No.
1; thence along common boundary of Lot No.1, South 78
degrees 38 minutes 53 seconds West, 314.06 feet to a set iron
pin at common corner of the within described lot and lands
now or formerly of John & Ogal Smith; thence along lands of
Smith, North 5 degrees 15 minutes 56 seconds, 532.92 feet to
a set iron pin, the place of BEGINNING.
CONTAINING 3 total area of 3.7390 acres more or less.
