Eugene Kilmore, Jr. (the "Owner"), contemporaneously herewith has executed or is about to execute a contract with Lobar Associates (the "Contractor") for the renovations of a building, upon that certain land now owned by Owner situate in Lower Allen Township, Cumberland County, Pennsylvania, more particularly bounded and described on Exhibit A attached hereto. NOW, this September 8, 2000, at the time of and immediately before the execution of the said principal contract, and before any authority has been given by the Owner to the Contractor to commence work on, or to furnish or purchase materials for the aforesaid renovations, in consideration of the making of said contract with the Contractor and the further consideration of One Dollar to the Contractor paid by Owner, it is agreed that no liens or claims shall be filed or made against said building and/ or land, or any part, piece, parcel or lot thereof, by the Contractor, or any subcontractor, or by any materialmen, workmen or other persons for or on account of any labor provided or materials furnished or purchased, or any extra labor or materials provided, furnished or purchased for said building or construction, hereby expressly waiving any and all rights to file or make such liens and claims. ~ _",..". " " AND, in furtherance hereof, the Contractor does hereby represent and warrant that as of the time of the execution hereof, neither the Contractor, nor any sub- contractors, materialmen, workmen or any other persons have commenced any work on, or furnished or purchased any materials for the aforesaid building or construction. Walker, P.E., dated 7/31/80 and recorded in Cumberland County Plan Book 39, Page 5, as follows, to wit: BEGINNING at a point on the North line of Century Drive between Tract No.3 and Tract No.4 on aforesaid Plan; thence along the easterly line of Tract No.3, North 63 degrees 57 minutes 00 seconds West, 490.92 feet to a point at line of lands now or formerly of Methodist Home; thence along same North 54 degrees 44 minutes 11 seconds East, 393.18 feet to a point between Tract No.4 and Tract No.5 on aforesaid Plan; thence along the westerly line of Tract No.5, South 42 degrees 16 minutes 43 seconds East, 366.04 feet to a point on the North line of Century Drive; thence along same by a curve to the left having a radius of 355 feet, a lineal distance of 165.71 feet to a point; thence along same South 26 degrees 03 minutes 00 seconds West, 50 feet to a point, the place of BEGINNING.
