VARNER and JENNIFER L. VARNER, ("Owners"), the Owners of the real estate described below, have executed a Contract dated August 7,2000 with S&A CUSTOM BUILT HOMES, INC., ("Contractor"), whose principal place of business is located at 501 Rolling Ridge Drive, Suite 200, State College, Pennsylvania 16801 and more particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and NOW, THEREFORE, this ~ day of September, 2000, before any authority had been given by Owners to Contractor to commence work on said facilities or purchase materials for same, in consideration of making of the above-described Contract with Owners, and in further consideration of One ($1.00) Dollar paid to Contractor by Owners, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owners' facilities and the land above-described by the Contractor or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor or materials purchased, or extra labor or materials purchased for, towards, in or abut the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities and the land above-described, being hereby expressly waived by the Contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. ";;~Li EXHIBIT "A" ALL that certain tract or parcel of land situated in South Middleton Township, Cumberland County, Pennsylvania, being known as Lot No. 15 on that certain Final Subdivision Plan, Meadowood Site Plan, dated February 9, 2000, prepared by Advantage Engineering Services, Inc. and recorded in Cumberland County Plan Book 81, Page 52, being bounded and described as follows: BEGINNING at an iron pin, being the southern corner of Lot No. 14, and lying in the western right-of-way line of Mea do wood Place; thence along said right-of-way, South 05027' 20" West, a distance of 93.51 feet to an iron pin, lying along said right-of-way and being the eastern corner of Lot No. 16; thence along Lot 16, North 820 40' 03" West, a distance of 163.28 feet to a corner post, being the common corner of Lot No. 16, lands owned now or formerly by Earl Brenneman (Deed Book 19-T, Page 80) and Lot No. 13; thence along Lot 18, North 070 28' 57" West, a distance of 90.46 feet to an iron pin, being the eastern corner of Lot 18 and the western corner of Lot No. 14; thence along Lot No. 14, South 840 32' 40" East, a distance of 183.45 feet to an iron pin, the point and place of beginning.
