JUDGMENT NOTE
JAMES WASHINGTON, SR, and JAMES WASHINGTON, JR., as Attorney-in-Fact for James
Washington, Sr., known as "Makers", promises to pay to HCR MANORCARE HEALTHCARE
SERVICES, as "Holder", of940 Walnut Bottom Road, Carlisle, PA., 17012, its successors and/or
assigns, the principal sum ofFifty Thousand Nine Hundred Ninety-Nine and 73/100 ($50,999.73) plus
accrued interest in the amount of Five Thousand Eight Hundred Seventy-One and 081100 ($5,871.08) for
a total ofFifty-six Thousand Eight Hundred Seventy and 81/100 Dollars ($56,870.81) with a daily
interest per diem of$25.15 from September 1, 2000. The entire balance of the principal ofthis Note and
the accrued interest thereon shall become immediately payable upon demand. Makers shall have the right
to prepay all or any part of the principal amount ofthis Note at any time or from time to time without
premium or penalty, provided that Makers pay at the same time all intere~t accrued thereon to the date of
payment. In addition, Makers do hereby authorize and empower the Prothonotary or any Attorney of any
Court of Record of Pennsylvania or elsewhere to appear for and enter judgment against them for the
above sum, with or without declaration, with costs of suit, release of errors, without stay of execution,
and with 15 percent added for collection fees; and Makers hereby agree not to make any motion or any
application whatsoever to any Court for an inquisition on any real estate that may be levied upon to
collect the aforesaid sum, and Makers voluntarily condemn same, and authorize the Prothonotary to enter
said voluntary condemnation upon the Writ of Execution. Makers further agree that any property, real
personal or mixed may be sold through a Writ of Execution and further hereby waive and release all relief
from any and alI appraisements, stay or exemption of any State now in force or which are passed
hereafter. The lien ofthis Judgment shall he limited to real property known and numbered all 275
West Ridge Street, Carlisle, Cumberland County, Pennsylvania, NO SING~E EXERCISE OF THE
FOREGOING POWER TO CONFESS JUDGMENT SHALL BE DEEMED TO EXHAUST THE
POWER WHETHER OR NOT ANY SUCH EXERCISE SHALL BE HELD BY ANY COURT TO BE
VALID, VOIDABLE, OR VOID, BUT THE POWER SHALL CONTINUE UNDIMINISHED AND IT
MAY BE EXERCISED FROM TIME TO TIME AS OFTEN AS THE HOLDER HEREOF SHALL
ELECT, UNTIL SUCH TIME AS THE HOLDER HEREOF SHALL HAVE RECEIVED PAYMENT
IN FULL OF ALL AMOUNTS OWING HEREUNDER, TOGETHER WITH COSTS.
