OBJECTIONS
The Plaintiff, KEYSTONE FINANCIAL BANK, N.A., by and through its attorney's Zimmerman,
Lieberman & Derenzo, L.L.P., hereby responds to Defendant's Preliminary Objections as follows:
I. PROCEDURAL HISTORY
The instant action was initiated by the Plaintiff, Keystone Financial Bank, N.A., acting
without counsel by the filing of a District Justice Complaint before the Honorable James Reiley of
District Court 21-3-07 on or about February 15,2000. After a hearing before District Justice Reiley,
the District Justice entered judgment in favor of Keystone Financial Bank, N.A., and against the
Defendant in the amount of $6,774.94.
The Defendant, Mr. Shaffer filed an Appeal of the District Justice's judgment to the above
term and number in the Court of Common Pleas of Schuylkill County. After the Appeal was filed,
Keystone Financial Bank, N.A., through counsel filed and served upon the Defendant, a Complaint
to the above term and number. The Defendant has now filed Preliminary Objections to the Plaintiff's

Complaint alleging I) improper venue; and 2) failure to plead paragraph 6 of the Complaint
specifically enough.
II. Kevstone Financial Bank. N.A.'s. Consent to Change of Venue.
Rather than oppose the Defendant's Preliminary Objection raising improper venue, Plaintiff,
Keystone Financial Bank, N.A., consents to this Court entering an Order changing venue to
Cumberland County, which is the County where the Defendant resides.l
III. Response to Preliminary Obiection Requesting More Specific Pleading
The instant action is based on the Defendant's failure to abide by his vehicle lease with
Keystone Financial Bank, N.A. The Bank in its Complaint is suing for the deficiency due under the
lease after the Defendant, defaulted on the lease for non-payment, the vehicle was repossessed, sold
by Bank in a commercially reasonable manner and the proceeds of the sale which were applied to the
Defendant's lease account were not sufficient to payoff the account.
The Defendant, through counsel, objects to Paragraph 6 of the Plaintiff Complaint as not
being specific enough. Paragraph 6 of the Plaintiff s Complaint states "The Defendant defaulted
under the terms of said lease." This averment is immediately after Paragraph 5 of the Complaint
which sets forth the Defendant's monthly payments pursuant to the lease. The Complaint goes on
to indicate that after the default averment in Paragraph 6, the leased vehicle was repossessed, sold and
demand made for the deficiency. A copy of the Statement of Sale letter demanding the deficiency
balance of $6,652.44 is attached to the Complaint. The Defendant is being sued for his failure to pay
the deficiency, not for his initial default averred in Paragraph 6 of the Complaint which led to the
repossessIOn.

Accordingly the averments of Paragraph 6 of the Complaint do not need to be pled more
specifically. For the reasons set forth above, the averments of Paragraph 6 are not essential to the
action. Plaintiff is not suing Defendant for the default averred in Paragraph 6. Plaintiff is suing the
Defendant for his default in paying the deficiency balance after repossession and sale of the vehicle.
These facts are specifically set forth in Paragraphs 10, II, 15 and Exhibit "C" which is attached to
and incorporated into the Complaint. Moreover, the Defendant is aware ofthe type of default averred
in Paragraph 6, it was for non payment. This is just an excuse to try and delay the instant
proceeding. Finally, to Plaintiff's knowledge the Defendant has failed to follow the Rules of Civil
Procedure in that the Defendant has failed to Brief its Preliminary Objections and therefore the
Defendant's objection should be waived.

AND NOW, comes the defendant, KENNETH B. SHAFFER, by and
through his attorney, Robert B. MacIntyre, and respectfully makes
the following preliminary objections to plaintiff's complaint:
I. PETITION RAISING QUESTION OF IMPROPER VENUE
1. This action has been instituted by plaintiff in
Schuylkill County, Pennsylvania.
2. Defendant is an adult individual who resides at 4150
Valley Street, Apartment A, Enola, Cumberland County,
Pennsylvania.
3. The venue of this action is improper in this county,
since under Pennsylvania Rule of Civil Procedure l006(a),
plaintiff may only bring this action against an individual in and
only in a county where he may be served, or where the cause of
action arose, or where a transaction or occurrence took place.

4. Plaintiff's complaint sets forth a cause of action
which arose in Cumberland County, Pennsylvania, as a result of
defendant's lease of an automobile from a Cumberland County auto
dealership on August 26, 1996.
5. Plaintiff alleges in paragraph 4 of its complaint that
the lease was assigned to Pennsylvania National Bank t/a
Pennsylvania National Banklease.
6. Plaintiff's complaint contains as Exhibit A the
original automobile lease. In said lease, Pennsylvania National
Banklease is identified as being situate at 130 Court Street,
Williamsport, Lycoming County, Pennsylvania. Similarly, the
title to the vehicle lists the same Lycoming County address.
7. Plaintiff has failed to allege any specific
transactions or occurrences which have taken place in this
county.
8. Plaintiff has failed to plead when plaintiff became the
successor to Pennsylvania National Bank.
9. Defendant does not and did not transact or conduct any
business in Schuylkill County.
10. Plaintiff maintains at least 4 bank branches in
Cumberland County, along with some administrative offices in
Carlisle, the county seat.
11. Venue in this county is improper under Pa. R.C.P.
1006 (a) .

WHEREFORE, defendant requests that plaintiff's complaint be
dismissed for improper venue.
II . MOTION FOR MORE SPECIFIC PLEADING
12. Paragraph 6 of plaintiff's complaint alleges that "the
Defendant defaulted under the terms of said Lease."
13. Pa. R.C.P. 1019(a) requires that the material facts
upon which a cause of action is based shall be stated in a
concise and summary form.
14. The aforementioned paragraph 6 fails to set forth with
sufficient specificity the manner and/or means by which defendant
allegedly defaulted under the terms of the lease.
WHEREFORE, defendant requests this Court order plaintiff to
more specifically plead the averments of paragraph 6 of its
complaint.

COMPLAINT
The Plaintiff, KEYSTONEFINANCIALBANK,N.A., by and through its Attorneys, Zimmerman,
Lieberman, & Derenzo, L.L.P., hereby brings the following cause of action against the Defendant
Kenneth B. Shaffer and in support thereof avers as follows:
I. The Plaintiff is Keystone Financial Bank, N.A., a national banking association with a place
of business located at One South Centre Street, Pottsville, Schuylkill County, Pennsylvania, 17901.
The Plaintiff is the successor by name change to the Pennsylvania National Bank also known as the
Pennsylvania National Bank and Trust Company also known as Pennsylvania National Bank Lease.
2. The Defendant is Kenneth B. Shaffer, an adult individual with a last known address at 4150
Valley Street, Apartment A, Enola, Pennsylvania, 17025.
3. On or about August 26, 1996, the Defendant executed a Pennsylvania National Bank
automobile Lease with Forbes Chevrolet as Lessor and Defendant as Lessee for the Lease of a new
1996 Chevrolet Blazer Serial No. IGNDTl3W4T2300803 (the "Blazer"). A true and correct copy
of the Lease is attached hereto and made a part hereof as Exhibit "A".
4. Forbes' Chevrolet interest in the Lease was then assigned to Pennsylvania National Bank tla
Pennsylvania National Bank Lease, the predecessor to the Plaintiff.

5. Pursuant to the terms of the Lease the Defendant was to pay the Plaintiff sixty (60) monthly
rental payments of $329.93.
6. The Defendant defaulted under the terms of said Lease.
7. On or about July 28,1999, pursuant to the terms and conditions of the Pennsylvania Uniform
Commercial Code and the terms and conditions of the Lease, the Plaintiff repossessed the Blazer.
8. On or about July 28, 1999, the Plaintiff mailed to the Defendant by certified mail at his last
known address, at that time, a Notice of Repossession giving the Defendant a fifteen (15) day period
to redeem the Blazer. A true and correct copy of that Notice of Repossession is attached hereto and
made a part hereof as Exhibit "B".
9. The Defendant failed and refused to redeem the Blazer and the Plaintiff liquidated the Blazer
in a commercially reasonable manner and the proceeds of the liquidation were applied to the balance
of the Lease.
10. On or about October 27, 1999, the Plaintiff sent a Notice of Statement of Sale to the
Defendant showing the proceeds of the sale of the Blazer, plus the deficiency balance of $6,652.44
which was still due to the Plaintiff from the Defendant under the terms of the Lease.
11. The Statement of Sale Notice demanded payment from the Defendant to the Plaintiff in the
amount of $6,652.44. A true and correct copy of the Statement of Sale is attached hereto and made
a part hereof as Exhibit "C".
12. Pursuant to the terms of the Lease, the Defendant agreed to pay the Plaintiffs attorney's fees
and collection costs and all other expenses associated with the Lease.
13. The Plaintiff has incurred court costs with District Justice Reiley in the amount of $122.50.
14. The Plaintiff has already incurred attorney's fees in the amount of $200.00 and additional
attorney's fees will accrue in at least the amount of $500.00.

15. Despite demand, the Defendant fails and refuses to pay the Plaintiff any amount towards the
deficiency owed on the Lease on the Blazer.
WHEREFORE, the Plaintiff requests this Honorable Court to enter judgment in favor of the
Plaintiff Keystone Financial Bank and against the Defendant in the amount of at least $7,474.94
together with interest, costs of suit and additional attorney's fees and collection costs.

payments made and applied when requested in April 1999.
19. Plaintiff refused to accept telephone calls from
defendant following April 1999.
