The Plaintiffs are Robert and Julie Abel, husband and wife, residing at 2023 Mountain Pine Drive, Mechanicsburg, Cumberland County, Pennsylvania. 2. On or about October 29,1998 the Plaintiff, Julie Abel, was seriously injured in a motor vehicle accident when she was rear-ended by a motor vehicle being driven by the Defendant, Carey Shayne Hughes, and owned by the Defendant, Stephen S. Smith. 3. The Defendant, Stephen S. The Defendant, Carey Shayne Hughes, is an adult individual with the last known address of 1019 Monroe Street, Apartment 2, Steelton, Dauphin County, Pennsylvania, 17113. 5. As a result of the aforesaid accident, the Defendant, Carey Shayne Hughes, was charged with various criminal violations including driving under the influence. A copy of the police investigative report is attached hereto and marked Exhibit "A". It should be noted that Defendant Smith initially reported the vehicle stolen and then retracted the report during the State Police investigation. 6. It is believed and therefore averred, as stated on the police report, that the owner of the vehicle, Stephen S. Smith, Defendant herein, initially reported the vehicle stolen. Since that time the insurance carrier for Stephen S. Smith has indicated that Carey Shayne Hughes was, in fact, a permitted driver of the vehicle. Attached hereto and marked as Exhibit "B" is a copy of the insurance correspondence dated July 10,2000. 7. It is affirmatively averred that the Defendants have automobile insurance applicable to the accident in question. 8. On or about September 13, 2000 a Writ of Summons was filed against the above named Defendants. A copy of the Writ is attached hereto and marked Exhibit "C". 9. At the same time, the Sheriff of Cumberland County was directed to serve the Defendant, Stephen Smith, and was also directed to deputize the Sheriff of Dauphin County to effectuate service of process on the Defendant-driver, Carey Shayne Hughes. 10. The Sheriff of Cumberland County and the Sheriff of Dauphin County returned the Writs as "Not Found". Attached hereto are Sheriff Returns indicating the ,... ;" c. fz;~,"_,,-, ",'__', ,_, .'" >,. On or about October 11, 2000, the Writ of Summons was reissued and the Sheriffs in Cumberland County and Dauphin County were again directed to serve the Defendants, Smith and Hughes. A copy of the Praecipe to reissue is attached hereto and marked Exhibit "E". 12. The Sheriff of Dauphin County was unable to effectuate service upon Defendant Hughes. The Sheriff's Return indicated "Not Found" and that the Defendant had moved "2 months ago" and a nother Sheriff's Return indicating Defendant had moved a year ago. Attached hereto and marked Exhibit "F" are the Sheriff's Return(s). 13. In addition to the Dauphin County Sheriff's Return(s), the following efforts were made to ascertain the whereabouts of Defendant Hughes: a. A check of the Department of Transportation indicated that Defendant, Carey Shayne Hughes, has no record in PaDOT files. A copy of the response is marked Exhibit "G". b. A search of the Dauphin County tax records and voter registration records was unable to provide any information as to the whereabouts of Defendant Hughes. Affidavit attached as Exhibit "H". c. Contact with criminal counsel for Defendant Hughes, Sanford Krevsky, Esquire, provided the last employer of Defendant Hughes and hearsay information that Defendant Hughes may have relocated to the state of Florida. No additional information on the whereabouts of Carey Shayne Hughes has resulted from contact with postal authorities, a check of the Dauphin County phone directory, the Defendant's last known employer and efforts to ascertain Defendant's whereabouts in the State of Florida. Attached hereto is the Affidavit of Tracy Finkenbinder marked as Exhibit "Y'. 14. In reference to the Defendant Smith, in addition to the Sheriff's Return referred to in paragraph 1 0 hereof, various attempts to make personal service on Defendant Smith have resulted in evidence that Defendant Smith is attempting to conceal his whereabouts. In support thereof Plaintiffs aver as follows: a. The Dauphin County Sheriff indicated that personal service on Defendant Smith was made upon "Todd DeBlasio, adult in charge" at the last known address of Defendant Smith, 226 Marlette Drive, Mechanicsburg, PA. (Sheriff's Return marked Exhibit "K") b. On or about October 18,2000 the Mechanicsburg Postmaster advised the Sheriff of Cumberland County that Defendant Smith had moved and left no forwarding address (Sheriff's Address Information Request attached as Exhibit "L"). c. Contrary to the information as set forth above, the Sheriff Return attached as Exhibit "M" indicates that Stephen S. Smith was personally served on October 25, 2000 (Sheriff's Return is attached as Exhibit "M"). d. Contrary to the information set forth above, Sheriff's Return dated November I, 2000 attached as Exhibit "N" indicates that Defendant Smith no longer resides at address stated, "current resident, Todd DeBlasio, stated that Defendant has not resided at this address for several months, left no forwarded address with Post Office." 15. In addition to Plaintiffs' attempts at personal service, the following efforts have been made to ascertain the whereabouts of Defendant Smith, said efforts indicating that the last known address of Defendant Smith is as stated at 226 Marlette Drive, Mecharricsburg,Pi\: a. Contact with the criminal attorney representing Defendant Hughes (See Exhibit "I"). b. Inquiries made oftelephone service, including calls to Defendant's last known number, postal authorities, Cumberland County tax office, Cumberland County voter registration, Hampden Township tax collector (please refer to i\ffidavit of Tracy Finkenbinder attached as Exhibit "1"). 16. Plaintiffs have contemporaneously filed a Praecipe to Reissue the Writ of Swnmons and directing the Sheriff to again attempt personal service on both Defendants. 17. It is affirmatively averred that upon the averments hereinbefore set forth that Defendants Hughes and Smith are attempting to either conceal their whereabouts and/or are, and have, attempted to avoid service of process. 18. Considering the conflicting information received from the Sheriff's Department, Plaintiffs request service on Defendant Smith by publication in order to avoid potential arguments regarding proper service. Service by publication does no hann even if Defendant Smith was properly served. 19.
