COMPLAINT IN CIVIL ACTION AND NOW COMES, Plaintiff, Castelle, ("Plaintiff"), by and through its Counsel, Weltman, Weinberg & Reis, Co., L.P.^" and hereby files this Complaint in Civil Action against the Defendant, CP Computers, Inc. a/k/a Computer, Inc. d/b/a Valens Information Systems d/b/a Eastern Computer Distribution ("Defendant Business"). In support thereof, Plaintiff avers as follows: I. Plaintiff is a business with offices at 3255-3 Scott Boulevard, Santa Clara, California 95054. 2. Defendant is a business with offices located at 4909 Louise Drive, Suite 101, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. At all time relevant, Plaintiff provided services and/or equipment to Defendant Business. 4. On or about September 8, 1998, the Plaintiff shipped to Defendant Business certain equipment in the amount of $995.00. A true and correct copy of the invoice is attached hereto as Exhibit "A" and made a part hereof. 5. Subsequent to the shipping of said equipment to Defendant Business, Plaintiff obtained a tracking summary from the United Postal Service for proof of delivery indicating the date of delivery of said equipment on ~ " ~". . :i September 10, 1998 and September 14, 1998. A true and correct copy of the UPS Tracking summary is attached hereto as Exhibit "B" and made a part hereof. 6. Defendant Business has had the benefit of the equipment provided by the Plaintiff and without paying, Defendant Business has been unjustly enriched. 7. Although repeated request to pay the balance due and owing Plaintiff made upon Defendant Business, Defendant Business has willfully failed and/or refused to pay the entire amount of the due to Plaintiff. WHEREFORE" Plaintiff, Castelle, respectfully demands Judgment in its favor and against Defendant, CP Computers, Inc. aJk/a Computer, Inc. d/b/a Val ens Information Systems d/b/a Eastern Computer Distribution, in the amount of $995.00, with continuing interest thereon at the legal rate of 6% per annum from the date of Judgment. plus any additional attorneys' fees and costs.
