COMPLAINT
1. Plaintiff, Dickinson College ("Dickinson"), is a Pennsylvania educational institution with its
principal offices located in Carlisle, Cumberland County, Pennsylvania 17013.
2. Defendant, John David Carr ("Student"), is an adult individual whose last known address
is 3923 Rodby Drive, Jacksonville, Florida 32210.
3. On or about May 13, 1997, Student entered into a Loan Contract (hereinafter "Contract # 1 ")
for goods and services to be provided and rendered to Student by Dickinson during the Summer of 1997
Program. A true and correct copy of Contract # 1 is incorporated by reference and attached hereto as
Exhibit "A. n
4. On or about February 23, 1998, Student entered into an Educational Goods and Services
Retail Installment Contract (hereinafter "Contract #2") for goods and services to be provided and
rendered to Student by Dickinson during the 1998 academic year. A true and correct copy of Contract #2
is incorporated by reference and attached hereto as Exhibit "B. n

BREACH OF CONTRACT
5. Paragraphs 1 to 4 are hereby incorporated by reference as if set forth in full below.
6. Under the terms of Contract #1, Student agreed to pay Dickinson Three Thousand, Four
Hundred Dollars ($3,400) with interest at the rate of 6% per annum in equal monthly installments with a

minimum monthly payment of Forty Dollars ($40.00) and a maximum repayment period offive years
beginning six months after the date of graduation or the date Student ceased to matriculate at Dickinson.
7. Section III of Contract # 1 provides that, "If I fail to make a scheduled repayment of any
installment, the entire unpaid indebtedness including interest due and accrued thereon, plus any
applicable penalty charge, will, at the option of Dickinson College, become immediately due and
payable."
8. Section IV of the Contract #1 provides that, "If! fail to make timely payment of all or any
part of a scheduled installment, I promise to pay the charge assessed against me by Dickinson College.
No charge may exceed $1.00 for the first month or part of a month by which the installment is late, and
$2.00 for each month or part of a month thereafter. I promise to pay all attorney's fees and other
reasonable collection costs and charges necessary for the collection of any amount not paid when due."
9. Under the terms of Contract #2, Student agreed to pay Dickinson Twelve Thousand, Three
Hundred Dollars ($12,300.00) with a variable interest rate, in one hundred, thirty-four (134) equal
monthly installments of One Hundred, Forty-Nine Dollars and Twenty-Six Cents ($149.26) commencing
on March 28, 1998.
10. Section II of Contract #2 provides that, "If a payment is more than IS days late, a sum
equivalent to 5% of the late payment (but no more than $2.50 and not less than $1.00) may be charged."
II. Section VI, Paragraph 3 of Contract #2 provides that, "[Student] shall be deemed to have
committed an 'Event of Default' of the Contract upon the occurrence of any of the following: (a) failure
to make any payment on or before the date it is due,..."
12. Section VI, Paragraph 4 of Contract #2 provides that if an Event of Default of the Contract
occurs, and is not cured by the Student pursuant to the Notice of Default, Dickinson has "the right to
declare all sums due on the Contract to be immediately due and payable."

13. Student defaulted on his obligation under the Contracts by failing to make the required
monthly payments when due.
14. Dickinson has demanded payment of the obligation owed to it by Student, but Student has
failed and refused to pay the remaining debt.
15. In accordance with the terms of the Contracts, Dickinson has exercised its right to declare all
sums due on the Contracts to be immediately due and payable.
16. The total amount now due and owing to Dickinson by Student pursuant to the Contracts is
Eighteen Thousand Eight Hundred Eighty Two Dollars and Forty-three Cents ($18,882.43), which
includes principal in the amount of Fifteen Thousand Seven Hundred Dollars ($15,700.00), interest in the
amount of Three Thousand One Hundred Seventy Two Dollars and Forty Three Cents ($3,172.43), late
fees in the amount ofTen Dollars ($10.00), plus attorneys' fees and collection costs.
WHEREFORE, Dickinson demands judgment against Defendant, John D. Carr, in the sum of
Eighteen Thousand Eight Hundred Eighty Two Dollars and Forty-three Cents ($18,882.43); plus interest
at the rate of 10.50% from September 7, 2000, late fees, attorneys' fees, collection costs, and costs of
suit.

IN QUANTUM MERUIT
In the alternative, ifthis Honorable Court should determine that express Contracts between
Dickinson and Student do not exist, which is denied, Dickinson pleads the following Count in q,uantum
meruit:

18. Student requested Dickinson to loan money, and Student received a benefit in the form of
goods and services valued at Eighteen Thousand Eight Hundred Eighty Two Dollars and Forty-three
Cents ($18,882.43).

19. Student has been unjustly enriched by accepting said goods and services without paying
Dickinson rellsonable compensation therefor.
20. The total amount by which Student has become enriched on account of the money loaned is
Eighteen Thousand Eight Hundred Eighty Two Dollars and Forty-three Cents ($18,882.43).
21. Dickinson has demanded payment ofthe above sums but Student has failed and refused to
do so.
WHEREFORE, Plaintiff Dickinson College demands judgment against Defendant, John David
Carr, in the sum of Eighteen Thousand Eight Hundred Eighty Two Dollars and Forty-three Cents
($18,882.43), plus interest, costs of suit, collection costs, and such other relief as this Court deems just
and proper.
