T~ : NO. fHJ - t,. '13/ L-.W<-t' ROCCO W. PALADINO, Ill, and DOLOREZA PALADINO, Defendants CIVIL ACTION - LAW COMPLAINT AND NOW comes the plaintiff, by and through her attorney, James H. Turner, Esquire, and makes the following complaint. 1. Plaintiff, Genevieve Paladino, is an adult individual residing at 17 South 17th Street, Camp Hill, Cumberland County, Pennsylvania. 2. Defendants, Rocco W. Paladino, III, and Doloreza Paladino, are adult individuals, husband and wife. Defendant Rocco W. Paladino, Ill, maintains his principal place of residence at 6059 Edwards Drive, Mechanicsburg, Cumberland County, Pennsylvania. Defendant Doloreza Paladino resides at 305 Shepherd Lane, Shippensburg, Pennsylvania. 3. On or about June 29, 1995, plaintiff and defendants jointly purchased property known as 6059 Edwards Drive, Mechanicsburg, Cumberland County, Pennsylvania. Said property was purchased by the parties as joint tenants with right of survivorship and subject to an oral agreement between the parties. Plaintiff provided all of the funds for said purchase. 4. Pursuant to the agreement of the parties, defendants were to occupy the premises and pay all costs associated therewith, including but not limited to mortgage payments and property maintenance. 5. Upon plaintiff occupying a portion of the property, plaintiff was to contribute to the maintenance of the property the sum of $300.00 per month. 6. Defendants, in breach of the agreement of the parties, failed to maintain the property and failed to pay the mortgage payments thereon. 7. As a result of the failure of defendants to maintain the property, plaintiff has been forced to expend various sums for the maintenance and improvement of the property as follows: (a) (b) (c) (d) (e) (t) (g) $ 8,500.00 $ 8,597.94 $ 4,324.52 $ 4,300.00 $ 1,611.79 $ 4,800.00 $ 941.00 heating and air conditioning siding windows storage room McWilliams-misc. repairs taxes sewage $33,075.25 total 8. As a result of the failure of defendants to pay the mortgage payments on the property, the plaintiff has been forced to expend an amount in escess of $4,000.00 to keep the mortgage current. 9. All of the payments made pursuant to paragraphs 7 and 8 above are in excess of plaintiffs obligations under the oral agreement between the parties. 10. Plaintiff has requested reimbursement of the above sum of defendants, which claims have been refused. "" . ,--, ' ","" ,--p ~. Count II 11. The allegations of paragraphs 1 and 2 are repeated and incorporated herein by reference. 12. On or about January 1, 1997, and February 1, 1997, plaintiff, at the request of defendants, loaned to defendants the sum of $2,200.00, which sums defendants requested plaintiff to pay to defendants' landlord. 13. The plaintiff made other loans to defendants on the dates and in the amounts set forth below: (a) (b) (c) February 1998 February 1998 February 1998 $2,198.00 for back rent $ 300.00 for bad checks $2,021.57 for sofa 14. Said loan was payable by defendants to plaintiff upon demand. 15. Plaintiff has demanded payment of said sum by defendants, which demand has been refused by defendants. WHEREFORE, plaintiff requests your Honorable Court to enter judgment in favor of plaintiff and against defendants in the amount of$6,619.57 plus interest and costs of this action. 0~~/ James H.
