From birth until approximately April 1996 - with MOTHER and FATHER on South 15th Street in Camp Hill, Pennsylvania. B. From approximately April 1996 until February 1998 - with MOTHER and FATHER on High Street in Camp Hill, Pennsylvania. C. From approximately February 1998 until present - with MOTHER at 720 Allenview Drive, Mechanicsburg. Cumberland County, Pennsylvania. 7. The mother of the children is Plaintiff, Christine A. Pepperman. She is single. 8. The father of the children is Defendant, David B. Pepperman. He is married. 9. The relationship of Plaintiff to the children is that of natural mother. Plaintiff currently resides with the following persons: the two minor children. 10. The relationship of Defendant to the children is that natural father. The Defendant currently resides with the following persons: Cathy Pepperman - wife; Marissa, 10 years old - Cathy Pepperman's young daughter; Cecilia, 11 years old - Cathy Pepperman's young daughter. 11. MOTHER has not participated as a party or witness, or in any other capacity, in any other litigation concerning the custody of these children in this or another court. 12. MOTHER has no information of a custody proceeding concerning the children pending in a court of this Commonwealth. 13. FATHER's contact with the children has been sporadic at best and has never been more than on an alternating weekend basis; D. The children have developed a trusting and loving relationship with MOTHER. 15. Each parent whose parental rights to the children have not been terminated and the person who has physical custody of the children have been named as parties to this action. WHEREFORE, MOTHER requests that the Court confirm primary custody of the children in her, subject to FATHER's periods of liberal partial custody to be exercised on an alternating weekend basis. PEPPERMAN, Defendant CIVIL ACTION - LAW CUSTODY ORDER OF COURT AND NOW, this:11 day of -~ooo, upon consideration of the attached Custody Conciliation Summary Report, it is hereby ordered and directed as follows: 1. Legal Custody. The parties, Christine A. Pepperman and David B. Pepperman, shall have shared legal custody of the minor Children, David P. Pepperman, born February 21, 1993, and Michael P. Pepperman, born January 13,1995. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the Children's general well-being including, but not limited to, all decisions regarding their health, education and religion. Pursuant to the terms of this paragraph, each parent shall be entitled to all records and information pertaining to the Children including, but not limited to, school and medical records and information. To the extent one parent has possession of any such records or information, that parent shall be required to share the same, or copies thereof, with the other parent within such reasonable time as to make the records and information of reasonable use to the other parent. 2. Physical Custody. The Mother shall have primary physical custody subject to Father's rights of partial physical custody which shall be arranged as follows: A. To commence October 27,2000, Father shall have the children on alternating weekends from Friday after school until Monday morning when he shall deliver them to school or to the summer daycare provider. To commence November 8,2000, on alternating Wednesdays from 4:00 p.m. until 8:00 p.m. This shall be the Wednesday evening schedule during the school year. During the summer, Father shall have custody Wednesday nights overnight until Thursday each week. 3. Holidays. The parties shall share the holidays equally as the parties shall mutually agree. 4. During the period of time wherein Mother has training with the National Guard and weekend obligations for the National Guard, Father shall have first right of refusal for custodial time when mother is unavailable. At her earliest opportunity, Mother shall provide notice to the Father as to what her schedule shall be for National Guard training. 5. Summer Vacation. Father and Mother shall each have two non-consecutive weeks of summer vacation. The parties shall endeavor to provide each other with at least a 30-day notice of the vacation weeks chosen. In the event that both parties have chosen the same week, the party first providing notice shall be entitled to choose that week. The vacation weeks for the parties are not to include the week before school begins each year. 6. The parties shall allow reasonable phone contact between the Children and the non-custodial parent during any period of custody. 7.
