Petitioner, Sean David Stefanic, is an adult individual having as an address 11 Falcon Court, Mechanicsburg, Cmnberland County, Pennsylvania, It should be noted that as of November of 1999, Mr. Stefanic became a resident of 1715 Hidden Bluff Terrace, Arlington, Texas, 76006, 2. The Respondent is the Pennsylvania Department of Transportation, Bureau of Driver Licensing, having as a mailing address at Department of Transportation, P.O. Box 68693, Harrisburg, PA 17106-8693. 3. On or about September 15, 2000, the Petitioner received a Notice of a license suspension. ,~ -flii\'1l;!;" 4. The basis of the suspension is an alleged test refusal on August 25, 2000, 5. The aforementioned suspension is invalid and inappropriate for the following reasons: A Petitioner did not refuse to take a test, specifically under oath, Officer Alan French of the Upper Allen Township Police Department signed an Affidavit of probable cause which reads: I then read Stefanic the Implied Consent Law and requested a test of his breath to which he agreed. B. It is a result of the request to take a test a reading was determined and being utilized to criminally prosecute the Petitioner. C. The suspension is invalid and otherwise inappropriate. D. To the extent that a refusal may have occurred, the subsequent offering of the test and completion of the test negates the initial refusal, which said initial refusal is specifically denied. 6. For the above reasons, Petitioner believes and therefore avers that the suspension is inappropriate and should be dismissed. -2- - ,- ~.
