Reliance Finance Company has a place of business located at 3810 Walnut Street, Harrisburg, PA 17109. 2, Claire Jeske resides at 247 Cypress Avenue, Johnstown, PA 15902. 3, On or around August 15, 1997 Claire Jeske purchased a 1988 Chevrolet Cavalier automobile from Reliance Finance Company, 4. At the time of sale, Reliance Finance Company and Claire Jeske entered into a motor vehicle installment sale contract, A copy of the same is attached hereto as Exhibit "A", 5, Said motor vehicle installment sale contract required Claire Jeske to pay to Reliance Finance Company 24 monthly payments of $133,35 beginning on September 12, 1997. 6. Claire Jeske is delinquent on her payments owed to Plaintiff, 7. On or about August 12, 1997, the Defendant, Clair Jeske, refinance said vehicle, which at that time had a balance of $2,595.16 and was refinanced for a total of $3,200.40. (A copy of installment contract is attached hereto as Exhibit "A."). 12. On February 20, 2000, said vehicle was sold by the Plaintiff for $5,245,00, A copy of a letter, dated March 27, 1998 is attached hereto as Exhibit "B." As result of the said sale, the outstanding balance on or about time of repossession was $2,650.80, plus repossession fee and certitled mail for a total of $3,008.72, As the result of the sale, said vehicle has a surplus of or a gain of $2,236.28. A copy of a Notice of Repossession, dated November 28, 2000, is attached hereto as Exhibit "C." WHEREFORE, Defendant, Clair Jeske, respectfully requests that this Honorable Court enter a judgement against the Plaintiff for the surplus from the sale of the vehicle in the amount of$2,236.28. By way of further response, in order to sell the repossessed vehicle, Plaintiff had to spend $2,623.24 on the vehicle for repairs, storage, etc. in order to get the vehicle ready for resale. All this brings to $136.87 (before Attorney fees and Court Costs) the total balance owed by Defendant to Plaintiff which is lower than the $410.61 pled by Plaintiff in their complaint. $2,650.80 + $355.06 (repo fee) + $2.77 (certified mail) +$2,623.24 (repairs, storage, etc.) = $5,631.87 less $5,495.00 = $136.87.
