The Plainliff, WALTER & JACKSON, INC., by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this
action of Assumpsit against the Defendant to recover the sum of EIGHT THOUSAND, FIVE HUNDRED FIFTY..FIVE
DOllARS AND SIXTY. THREE CENTS ($8,555.63), along with costs of this suit and interest thereon from February
29, 2000 upon a cause of action of which the following is a statement:
1. . The Plaintiff, WALTER & JACKSON, INC., is a corporation organized and existing under the laws
of the Commonwealth of Pennsylvania, having its principal offICe and place of business at P.O. Box 160, Christiana,
Pennsylvania 17509.
2. The Defendant, P. EDWARD MUlUN, is an adult indMdual trading and doing businesS as CUSTOM
BUILT HOMES and has an office and place of business at 446 Kerrsville Road, Carlisle, Cumberland County,
Pennsylvania 17013-9422.
3. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff"
books of original entry hereto attached, made a part hereof and marked Exhibit "A", Plaintiff, at the special instance
and oral request of the Defendant, sold and delivered goodS, wares and merchandise of the kind and description
set forth on said Exhibit to the total amount of EIGHT THOIJSAND, FIVE HUNDRED AND FIFTY .FIVE DOLLARS
AND SIXTY.THREE CENTS ($8.555.63).

4. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal
and market prices therefor and were the prices which the Defendant orally promised and agreed to pay P~'iintiff
therefor.
5. The balance due and owing by Defendant to Plaintiff is the sum of EIGHT THOUSAND, FIVE
HUNDREO FIFTY-FIVE DOllARS AND SIXTY-THREE CENTS ($8,555.63), as appears by the Statement of
Account hereto attached, made a part hereof and marked as Exhibit "A".
6. Plaintiff has frequently demanded payment from Defendant of said amount due and owing as
aforesaid, but Defendant has refused and neglected and still refuses and neglects to pay said amount of any part
thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of EIGHT THOUSAND, FIVE
HUNDRED AFTY-AVE DOLLARS AND SIXTY-THREE CENTS ($8,555.63), together With costs of this suit and
interest thereon from February 29, 2000.

EXPLANATORY COMMENT-1997
Tl1e Act of June 22, 1931, P.L. 883, 12 P.S. ~ 2358 et seq.,
when enacted, formed the basis for both the substantive and
procedural law governing sheriff's interpleader. The rules of
civil procedure -governing the same subject promulgated in
1965 suspended the procedural provisions of the statute' but
preserved certain other provisions,. However, in 1978 Section
2(a) of tl1e Judiciary Act Repealer Act (JARA), 42 P.S.
~ 20002(a) [11241, repealed the Act of 1931 in its entirety.
AI'i a result of the repear of the Act of 1931, the Supreme
Court of Pennsylvania has promulgated the following amend-
ments to the rules governing Sheriff's Interpleader but these
amendments do not affect practice and procedure:
1. Rule 3201 and the note to Rule 3205(b) are amended to
delete references to the repealed Act of 1931 or other repealed
statutes,
2. Rules 3202(b), 3205(b), 3206(a) and (d), 3207(a), (d)
and (e), 3208 and 3213 are amended to be gender neutral. .
3, Rule 3215 governing the effective date of the rules when
originally promulgated in 1966 is rescinded as obsolete.
4. Rules 3231(33) and (35), 3234, 3241(80) and 3246
governing Acts of Assembly are rescinded as obsolete. The
statutes preserved and suspended by these rules have been
repealed.
Rule 3203. Notice of Claim. Request
for Appraisal. Stay of Sale
When a claim is filed, the sheriff shall stay the
execution against the claimed property and forthwith
send a copy of the claim by ordinary mail to the
plairltiff, the defendant, and all other execution credi-
tors and claimants of the property, together with a
notice substantially in the form provided by Rule 3259,
that unless a party in interest requests an appraisal the
sheriff, without making an appraisal will accept the
value of the property set forth in the claim. The filing
of the claim shall not stay execution as to property not
included in the claim.
Note: When several writs of execution are
against the same defendant, see Rule 3115(a).

Rule 3205. Appraisal of Property.
Appraisal Fees
(a) Unless a party in interest files a request for
appraisal with the sheriff within ten days after the date
specified in the sheriffs' notice, the sheriff without
making an appraisal shall accept the value of the
property set forth in the claim.
(b) A party requesting an appraisal shall advance the
sheriff's appraisal fee. The sheriff shall then appraise
the property and immediately give notice, of the amount
of the appraisal by ordinary mail to ail parties to whom
the sheriff's notice was mailed. The sheriff or any party
in interest may apply to the court for an order -fIXing a
special appraisal fee where the appraisal of a large
quantity of property or the services of experts shall be
required.
Note: The Sheriff's Fee Act remains unaffected by these
rules. See Act of July 6, 1984, P.L. 614, No. 127, 42 P.S.

(a) If the sheriff determines that the claimant is
prima facie not the owner of the prope in whole or in

Rule 3276. Scope
The rules of this chapter govern proceedings pursuant
to Section 8103 of the Judicial Code, 42 Pa.C.S.,~ 8f03,
relating to deficiency judgments.
Note: Section 8103(a) of the Judicial Code provides for a
petition _to fix, the"fitir matket"value of real Jlroperty sOld in
execution proceedings-when:_ihe price for: the property sold is
. not sufficient to satisfy, the-amount of th~'judgment, interest
and' costs -and the judgment creditor seeks to collect the
