PETITION FOR APPEAL OF LICENSE SUSPENSION
1. Julia Mae Nesmith is an adult individual currently residing at 456 North West Street,
Carlisle Borough, Pennsylvania 17013,
2, On or about July 9, 2000, Pennsylvania Department of Transportation (PENNDOT)
sent to Appellant an Official Notice of License Suspension, but Appellant never received that notice
as it was addressed to Appellant at her former residence
3, On July 22,2000, Appellant was cited, while stopped for a burned out headlight, for
a violation of 75 Pa,C,S, Section 1543 (a), (Driving While Operating Privilege Suspended or
Revoked),
4, On September 25, 2000, the Appellant filed a timely Notice of Appeal from her
August 24, 2000 conviction of the July 22 citation, See Exhibit A,
5, On September 1, 2000, PENNDOT mailed to Appellant a second Official Notice of
Suspension, which Notice Appellant did receive as it was addressed to her current address, See
Exhibit B,
6, The Appellant believes that she will prevail in the criminal appeal because the
evidence was insufficient to convict her as a matter oflaw, See Commonwealth v, Williamson, 532

she did not have actual notice of her license suspension and therefore is not guilty of a violation of
75 Pa,C,S, Section 1543, See Commonwealth v, Crockford. 443 Pa, Super, 23, 66 A.2d 1336
(1995),
7, Ifthe Appellant's criminal appeal is sustained, then this civil appeal is moot.
WHEREFORE, Appellant requests this Honorable Court to set a time for a hearing on the
Appellant's Petition and immediately stay the imposition of her license suspension pending the result
of said hearing,

PRAECIPE TO WITHDRAW PETITION
FOR APPEAL OF LICENSE SUSPENSION
AND NOW, comes the Appellant, Julia Mae Nesmith, by and through her counsel of record,
Gregory H. Knight, Esquire, to file a Praecipe to Withdraw the above-referenced Petition for Appeal,
in support of which Praecipe the following statements are made:
1, On September 25, 2000, the Appellant filed a Notice of Appeal (Docket No, 2000-2060
Criminal Term) from an August 24, 2000 summary criminal conviction,
2, On September 29,2000, the Appellant filed a Petition for Appeal (Docket No, 2000-6627
Civil Term) from a license suspension imposed by PennDot as a result of the August 24, 2000
convictions,
3, On December 12, 2000, the Appellant was found not guilty at a hearing on the Appeal
(No, 2000-2060 Criminal) of the August 24 conviction, See Exhibit A,
4, As noted in Paragraphs 6 and 7 of the Appeal (No, 2000-6627 Civil), the finding of not
guilty makes moot the license suspension Appeal (No, 2000-6627 Civil),
5, Counsel for PennDot agrees that the license suspension Appeal (No, 2000-6627 Civil) is
now moot, See Exhibit B,

WHEREFORE, the Appellant requests that the above-referenced Appeal be withdrawn and
that the Court issue the attached proposed Order holding that this Appeal is moot.

Dear Attorney Knight:
I am in receipt of your fax of December 14, 2000, regarding the above-mentioned matter.
The fax includes an Order that indicates th&t your client, Julia Mae Nesmith, was found not
guilty of a 1543 offense, violation date July 22, 2000, Please be advised that the Department has
deleted and rescinded the section 1543 violation and the resulting suspension, See attached
computer printouts confirming the same,
A hearing is scheduled for December 18, 2000, at 1:30 p.m, in Courtroom No, 2,
Cumberland County, Carlisle. As a result of the motorist's record being corrected, a hearing is
not necessary, The matter could be disposed of by you withdrawing the appeal or by having a
hearing and having the matter dismissed of as moot. If you choose to file a praecipe to withdraw,
kindly provide me a copy of the praecipe so that I may close-out my file.
