STIPULATION AGAINST LIENS
THIS AGREEMENT made the 29th day of September, 2000, by and between DURHAM
HOMES, INC., hereinafter referred to as Contractor, and JEREMY L. PAISLEY and CRYSTAL
A. PAISLEY, hereinafter referred to as Owner, whereby the former undertook and agreed to erect
and construct a custom built home on that certain lot of ground situate at 11 Fox Hollow Road (Lot
No. 16, Maple Grove) Penn Township, Cumberland County, Pennsylvania, more fully described in
Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby. expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
ofthem, and agree that this instrument, waiving the right oflien, shall be an independent covenant.

ALL that certain tract ofland situate inPeun Township, Cumberland County, Pennsylvania, bounded
and described as follows, to wit:
BEGINNING at a point on the southern side ofF ox Hollow Lane, on the dividing line between Lots
16 and 17 on the hereinafter Final Subdivision Plan; thence by said line South 07 degrees 06 minutes
55 seconds East 594.72 feet to a point; thence by lands now or formerly of Linwood B. Phillips, Jr.
and E. Lucille Phillips, North 82 degrees 48 minutes 32 seconds West 196.19 feet to a point; thence
by the dividing line between Lots 16 and 15 on the hereinafter Final Subdivision Plan, North 02
degrees 30 minutes 16 seconds West 551.81 feet to a point; thence along the southern side of Fox
Hollow Lane South 85 degrees 55 minutes 12 seconds East 41.43 feet to a point; thence continuing
along the southern side of Fox Hollow Lane by a curve to the left having a radius of225.00 feet, an
arc length of 106.17 feet to a point, the place BEGINNING.
CONTAINING a total area of2.l981 acres and being Lot No. 16 on the Final Subdivision Plan for
Maple Grove (Phase 2) recorded in the Recorder of Deeds in and for Cumberland County in Plan
Book 79, Page 80.
