STIPULATION AGAINST LIENS
WHEREAS, Joseph J. Katkocin, of 3803 Pamay Drive, Mechanicsburg,
Pennsylvania is about to execute contemporaneously herewith, a contract with KA TKO, Inc.
of Post Office Box 370, Camp Hill, Cumberland County, Pennsylvania, for the erection of a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described to wit:
BEGINNING at a point on the southeastern right-of-way line of Valleybrook
Drive at the dividing line betweel1 Lot No. 35 and Lot No. 36 as shown on the hereinafter
mentioned pan of lots; thence along said right-of-way line North 33 degrees 32 minutes 35
seconds East, a distance of 95.00 feet to a point; thence by a curve having a radius of 10 feet
and an arc length of 15.71 feet to a point; thence South 56 degrees 27 minutes 25 seconds
East, a distance of 82.90 feet to a point; thence by a curve having a radius of 302 feet and an
arc length of 19.05 feet to a pint; thence South 33 degrees 02 minutes 07 seconds West, a
distance of 104.33 feet to a point at the dividing line between Lot No. 35 and Lot No. 36;
thence along said dividing line North 56 degrees 29 mil1utes 34 seconds West, a distance of
112.86 feet to a point, said point being the Place of BEGINNING.
THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 35 of the Final
Subdivision Plan of Hampden Hearth - Phase V recorded in the Cumberland County
Courthouse in Plan Book 59, Page 111. The above described tract containing 11,772.07
square feet, more or less.
THE ABOVE DESCRIBED-TRACT BEING SUBJECT TO various easements of
record as indicated on the above-referenced Subdivision Plan.

UNDER AND SUBJECT to an unnamed stream, a GO-foot drainage easement
centered on existing unl1amed stream and a 1 OO-year flood limit, all of which run along the
eastern portion of said lot.
ALSO UNDER AND SUBJECT to utility easement, sanitary and sewer easement
along the southern portiol1 of said lot.
UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book 340,
Page 491, and Miscellaneous Book 433, Page 942, in Cumberland County, Pennsylvania.
NOW, the day of September, 2000, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by the
said Joseph J. Katkocin, to the said KATKO, Inc. to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
KATKO, Inc. and the further consideration of One Dollar, to KATKO, Inc. paid by Joseph J.
Katkocin, it is agreed that no lien shall be filed against the building by the contractor, or any
sub-contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said building,
the right to fi Ie such I iens being expressly waived.
