Aragon 6400 Main Street, Apt. SA Columnbus,GA 31909 RE: Wayne J. Aragon vs. Michele M. Aragon No. 00 - 6786 Civil In Divorce Dear Ms. Adams and Ms. Aragon: I was appointed Master on January 29, 2001, to hear claims relating to divorce and equitable distribution. Ms. Adams, Attorney for the Plaintiff, returned a certification documnent indicating that discovery is complete. A request was made to Defendant's attorney (I do not know the name of the attorney or address) for income information of the Defendant. The certification indicates that the attorney stated that the information would be "forthcoming". Consequently, I think that it is appropriate to go forward with a directive for pretrial statements. A divorce complaint was filed on October 3, 2000, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were raised in the complaint. On January 26, 2001, a petition was filed by the Plaintiff raising the economic issue of equitable distribution and adding the grounds for divorce of indignities. I am going to proceed on the basis that the parties are not contesting the grounds for divorce and will either sign affidavits of consent and waivers of notice of intention to request entry of divorce decree or have been separated for a period in excess of two years so that we do not need to proceed on the indignities grounds. Ifmy assumnption regarding grounds for divorce is not correct, please advise and we will immediately schedule a hearing on the alternative grounds of indignities to the person. ~~ '. , ---, , ,,~ "i_"..t~;w'; .... Ms. Adams and Ms. Aragon 18 April 2001 Pal!e2 The economic issue before me is equitable distribution. In accordance with P.R.C.P. 1920.33(b) I am directing Jane Adams, counsel for the Plaintiff, and Michele M. Aragon or her counsel to each file a pretrial statement on or before Monday, May 14, 2001. Upon receipt of the pretrial statements, I will immediately schedule a pre-hearing conference with counselor with Ms. Aragon if she is not represented to discuss the issues and, if necessary, schedule a hearing. Very truly yours, E. Robert Elicker, II Divorce Master . NOTE: Sanctions for failure to file the pretrial statements are set forth in subdivision (c) and (d) of Rule 1920.33. THE ORIGINAL PRETRIAL STATEMENT SHOULD BE FILED IN THE MASTER'S OFFICE AND A COPY SENT DIRECTLY TO OPPOSING COUNSEL. FAILURE TO FILE PRETRIAL STATEMENTS AS DIRECTED BY THE MASTER MAY RESULT IN THE MASTER'S APPOINTMENT BEING VACATED. ;;1"'" ~ ~~- I~ , ~ ~ . c _ ~_ . o'~Jk.:~ IN 'm COURT OF COMMON PLEAS OF ctlMBE1U.AND COUNTY, PENNSYL V ANLI.
