ASSESSMENT OF CIVIL PENALTY
NOW, this 28th day of March 2000, the Commonwealth of Pennsylvania, Department of
Environmental Protection ("Department") has made the following findings:
A. The Department is the agency with the duty and authority to administer and enforce the
Radiation Protection Act ("Act"), Act of July 10, 1984, P.L. 688, No. 147,35 P,S. Sections 7110.101 et
seCl.; Section 1917-A of the Administrative Code of 1929, Act of April 9, 1929, P.L. 177, No. 175.!!!!
amended, 71 P.S. Section 510-17; and the rules and regulations promulgated thereunder.
B. 25 Pa. Code Section 216.2(a)(l) and 25 Pa. Code Section 218.11 of the Pennsylvania
Regulations for Radiological Health require individuals possessing a radiation-producing machine to
register with the Department within 30 days after acquisition and remit the appropriate registration fee.
C. Yvonne O. Miller, D.M.D. is an individual currently licensed by the Commonwealth of
Pennsylvania for the practice of dentistry, who maintains a private dental practice at 6350 Green Str.eet,
Philadelphia, Philadelphia County, Pennsylvania.
D. 25 Pa. Code Section 218.11 of the Pennsylvania Regulations for Radiological Health
requires individuals possessing a radiation-producing machine to remit the appropriate registration f,ee
upon filing for registratiofl for said machine.
E. On August 5, 1999, the Department conducted an inspection at the premises of Yvonne
O. Miller, D.M.D., at 6350 Greene Street, Philadelphia, Philadelphia County, Pennsylvania. It was
discovered during that inspection that YVOlU1e O. Miller, D.M.D. was in possession of two (2) S.S.
White Model Marksman I X-Ray machines for dental studies. These X-Ray machines are "radiation-
producing machines" and "radiation sources" as defined in Section 103 of the Act, 35 P.S. Section
7110.103, and in 25 Pa, Code Section 215.1.
F. [t has been detennined by the Department that the two (2) S.S. White Model Marksman I
X-Ray machines discovered during the inspection of August 5, 1999, said machines being possessed ~y
Yvonne O. Miller, D.M.D., were not registered with the Department as required by 25 Pa. Code Secl:Ion
216.2(a)(1),

. G. Operation of the two (2) S.S. White Model Marksman I X-Ray machines by Yvonne O.
MI~ler, ~.M.D., in addition to her failure to duly register the machines and to remit the required
regJstratJon fees, constituted unlawful conduct by Yvonne 0, Miller, D.M.D., pursuant to Section 307 of
the Act, 35 P.S. Section 7110.307, and a public nuisance under Section 309(a) of the Act, 35 P.S.
~ 7110J09(a).
H. For at least eight years (according to Yvonne O. Miller, D.M.D.), Yvonne O. Miller,
D,M.D. operated the two unregistered X-Ray machines above.
1. As a consequence of her unlawful conduct, Yvonne O. Miller, D.M.D. is subject to civil
penalty liability as set forth in Section 308(e) of the Act, 35 P.S. ~ 7l101.308(e).
1. Pursuantlo Section 308(e) of the Act, 35 P.S. ~ 7110.308(e), the Department may assess
a civil penalty of up to TWENTY FIVE THOUSN-iD DOLLARS ($25,000.00) for each violation of the
Act or regulations promulgated thereunder, plus up to FIVE THOUSAND DOLLARS ($5,000.00) J)or
each day of continued violation.
NOW THEREFORE, pursuant to Sections 7110J08(e) and 7110,301(c)(l9) of the Act, and the
regulations promulgated thereunder, the Department hereby assesses a civil penalty of TWO
THOUSAND FOUR HUNDRED DOLLARS (520400.00) against Yvonne O. Miller, D.M.D.
Said penalty shall be submitted to the Department in the form of a certified check, in the amount
of TWO THOUSAND FOUR HUNDRED DOLLARS ($2,400.00), made payable to "Commonwealth
of Pennsylvania, Radiation Protection Fund" within thirty (30) days of receipt of this Civil Penalty
Assessment, and mailed to Ivna O. Shanbaky, Ph.D.. Department of Environmental Protection, Lee
Park, Suite 6010,555 North Lane, Conshohocken. PA 19428.

to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market
Street, P.O. Box 8457, Harrisburg, PA 17105-8457,717-787-3483. TDD users may contact the Board
through the Pennsylvania Relay Service, 800-654-5984. Appeals may be filed with the Environmental
Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute
provides a different time period. Copies of the appeal form and the Board's Rules of Practice and
Procedure are also available in Braille or on audiotape fromthe Secretary to the Board at 717-787-3483.
This paragraph does not, in of itself, create any rights of appeal beyond that permitted by applicable
statues and decisional law.
