STIPUlATION AGAINST UENS
THIS AGREEMENT made the 4th day of October , 2000, by
and between W. LEE ROLAND, BUILDER, of 337 West Meadow Drive,
Mechanicsburg, Pennsylvania, hereinafter referred to as
Contractor, AND SANDRA K. GOODLING, of 321 East MeadOW Drive,
Mechanicsburg, Pennsylvania, hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a
residential dwelling on that certain lot of ground situate on
Windrush Lane, in Upper Allen TownShip, Cumberland County,
Pennsylvania, being Lot No. 28, Final Development Plan for Witney
Ridge Planned Residential Development Phase I, said plan being
recorded in Plan Book 80, Pages 63-64. Being part of the same
premises which Gene W. Hollinger and Dorothy J. Hollinger,
husband and wife, by Deed dated August 17, 1999 and recorded in
the Cumberland County Recorder of Deeds Office in Deed Book 206,
Page 23, granted and conveyed unto Witney Ridge Investors, LP.
Also being the same premises which Witney Ridge Investors, LP by
Deed dated October 2 , 2000 and recorded in the Cumberland
Recorder of Deeds Office in Deed Book , Page , granted
and conveyed unto W. Lee Roland and Rosalie H. Roland, husband
and wife. Further being the same premises which W. Lee Roland
and Rosalie H. Roland, husband and wife, by Deed dated
October 4 , 2000 and recorded in the Cumberland County
Recorder of Deeds Office in Deed Book , Page , granted
and conveyed unto Sandra K. Goodling.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said

contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
WITNESS our hands and seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.
