WHEREAS, Charter Home Building Corrpany, a Pennsyvlania Co:rporation of
Lancaster County, Pennsylvania entered into a contract with Charter Homes
Building Corrpany, Contract=, to provide materials and perform labor necessary
for the const:ruction of a single family dwelling house upon a lot of ground
located lDgan's Run, Lot #89, Phase III lDgan's Run, E. Pennsboro Thip.,
Cumberland County, PA.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said
parties, as part of the said contract and for the consideration therein set ~
forth, that neither the undersigned contractor, any sub-contractor or material
ll'aIl., nor any other person furnishing labor or materials to the said contractor
under this contract shall file a lien, camr:lnly called a mechanic's lien, for
work done or materials furnished to the said building or any part thereof.
This stipulation is rradeand intended to be filed with the County Prothonota:ty
in accordance with the re<ijirirerrents of Section 1402 of the Mechanics Lien Law
of 1963 of the COllllDnwealt,h o~ Pennsylvania in such case provided..

COMPLAINT
M & M Contractors, Inc., by and through their attorneys, Keith A. Noll, Esquire
and Maxwell Law Offices, aver the following in support of this Complaint:
1. Plaintiff is M & M Contractors, Inc., a Pennsylvania corporation with
principal offices at 221 West Martin Avenue, Shippensburg, PA 17257.
2. Defendants are Michael and Lei Lani Vaughn, husband and wife, sui juris
adults, residing at 117 Cumberland Avenue, Shippensburg, PA 17257.
3. On or about February 1, 1998, Plaintiff loaned to Defendants the sum of
Three Thousand ($3,000.00) Dollars, with interest accruing at the rate of twelve (12%)
percent per annum, pursuant to a letter signed by the Defendants, which is attached as
Exhibit A and incorporated by reference.
4. The loan was to be repaid in twenty four (24) monthly installments of
$188.29 per month.
5. Defendants made three payments on the loan, and received credit for
work done for Plaintiffs. Such payments and credits total One Thousand One Hundred
Two and 99/100 ($1,102.99) Dollars.

6. Defendants continue to owe $2,602.96, plus interest accruing at the rate
of twelve (12%) per annum.
7. Defendants have failed to make payment on this loan since January,
1999.
8. This amount sought by this Complaint is within the limits for arbitration
pursuant to Local Rule 1301.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter
judgment in favor of Plaintiff in the amount of Two Thousand Six Hundred Two and
