STIPULATION AGAINST LIENS
WHEREAS, Joseph J. Katkocin, of 3803 Pamay Drive, Mechanicsburg,
Pennsylvania is about to execute contemporaneously herewith, a contract with KA TKO, Ine.
of Post Office Box 370, Camp Hill, Cumberland County, Pennsylvania, for the erection of a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described to wit:
BEGINNING at a point on the northern right-of-way line of Wallingford Way,
said point being located at the southeast corner of Lot No. 232 of the Final Subdivision Plan
of Hampden Hearth Phase III recorded in the Cumberland County Courthouse in Plan Book
62, Page 139;
THENCE along said Lot No. 232 North Twenty-Five Degrees Zero Minutes Zero
Seconds West (N 25000' 00" W) a distance of One Hundred One and Four Hundredths Feet
(101.04 ft.) to a concrete monument on the southern line of Lot No. 230 of the above
referenced Hampden Hearth Phase III Subdivision Plan;
THENCE along said Lot No. 230 North Forty-One Degrees Four Minutes Thirty-
Seven Seconds East (N 410 04' 37" E) a distance of One Hundred Eight and Seventeen
Hundredths Feet (108.17 ft.) to a point on the western right-of-way line of Wallingford Way
at the easternmost corner of said Lot No. 230;
THENCE along the western and northern right-of-way line of Wallingford Way
by a curve to the right with a radius of One Hundred and Zero Hundredths Feet (100.00 ft.)
an Arc Length of One Hundred Ninety-Eight and Zero Hundredths Feet (198.00 ft.), the Chord
of said curve having a bearing of South Five Degrees Twenty-Five Minutes Three Seconds
West (S 050 25' 03" W) and a distance of One Hundred Sixty-Seven and Twenty-One
Hundredths Feet (167.21 ft.), to a point on the northern right-of-way line of Wallingford Way;

THENCE along the northem right-of-way line of Wallingford Way South Sixty-
Two Degrees Eight Minutes Twenty-Five Seconds West (S 62' 08' 25" W) a Distance of
Fourteen and Twenty-Four Hundredths Feet (14.24 ft.) to a point on the northem right-of-way
line of Wallingford Way at the southeast comer of the above referenced Lot No. 232, the Place
of Beginning.
The above described tract CONT AI N I NG Eleven Thousand Three H undred Two
and Sixty-Two Hundredths Square Feet, more or less (11.302.62 +/- sq. ft.) and BEING
KNOWN AS Lot No. 231 of the Final Plan of Hampden Hearth Phase III dated December 15,
1989, and last revised October 5, 1990, prepared by Grove Associates, Engineers & Surveyors,
and recorded in the Cumberland County Courthouse in the Office of the Recorder of Deeds
in Plan Book 62, Page 139.
UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book 340,
Page 491, and Miscellaneous Book 433, Page 942, in Cumberland County, Pennsylvania.
NOW, the day of October, 2000, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by the
said Joseph J. Katkocin , to the said KA TKO, Inc. to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
KATKO, Inc. and the further consideration of One Dollar, to KATKO, Inc. paid by Joseph J.
Katkocin, it is agreed that no lien shall be filed against the building by the contractor, or any
sub-contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said building,
the right to file such liens being expressly waived.
