STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~5'1J11.- day Of~, 2000, by and
between FARINELLI CONSTRUCTION, INC" hereinafter referred to as
Contractor,
AND
JEANNE K, FARINELLI, hereinafter referred to as Owners, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in Upper AJ.len Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot #2 Kacey Court, Mechanicsburq, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1,00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant,

ALL THAT CERTAIN tract or parcel ofland situate in the Township of Upper
Allen, County of Cumberland, Commonwealth of Pennsylvania more particularly
bounded and described as follows to wit:
BEGINNING at a point on the western right of way line of the Bumble Bee Hollow
Road T-614 Relocated (30' from centerline) at the dividing line between Lots #1
and #2 as shown on the hereinafter mentioned plan; thence along the dividing line
between Lots #1 and #2'Not'tlt-6°rees 02 minutes 00 seconds West a distmree-of
160.00 feet to a point at the dividing line between Lots #1, #2 and #3; thence along
the dividing line between Lots #2 and #3 North 21 degrees 58 minutes 00 seconds
East a distance of 291.82 feet to a point on the southern right of way line of Kacey
Court (50' wide); thence along the southern right of way line of Kacey Court by a
curve, curving to the left in an easterly direction having a radius of 175.00 feet and
an arc length of 25.28 feet to a point; thence continuing along the same South 68
degrees 02 minutes 00 seconds East a distance of 109.81 feet to a point; thence by a
curve, curving to the right having a radius of 25.00 feet and an arc length of 39.27
feet to a point on the western right of way line of Bumble Bee Hollow Road T-614
Relocated; thence along the western right of way of Bumble Bee Hollow Road T-614
Relocated south 21 degrees 58 millutes 00 seconds West a distance of 265.00 feet to a
point, said point being the place of BEGINNING.
BEING Lot #2 as shown on the Final Subdivision Plan of Chad Hazam. Said plan
being recorded in the Office of Recorder of Deeds, Cumberland County,
Commonwealth of Pennsylvania in Plan Book 60, page 4.
BEING the same premises which Chad Hazam and Karis Lewellen-Hazam,
husband and wife, granted and coveyed to Jeanne K. Farinelli, Borrower herein.
