AMENDED COMPLAINT
1. Plaintiff is Darius Real Estate, a commercial and residential real estate venture
who's principal place of business is located at 5319 Edgewood Drive, Alexandria,
Virginia, 22310. Robert G. Darius, of the same address, is the managing partner sind
party responsible for the business affairs of this organization.
2. Defendants, Robert and Adana Howell currently reside at 423 Shippensburo
Road, Apartment 1, Newville, Pennsylvania, 17241.
3. On or about July 25, 2000, Robert and Kathleen Darius, of Darius Real Estate,
entered into a lease agreement with the Defendants for the rent of the property at 423
Shippensburg Road, Apartment 1. A copy of said rental agreement is attached and
incorporated herein as attachment A.
4. The Defendants have resided there continuously since that date and reside there
currently.
5. Upon entering into the lease the Defendants paid a security deposit of $425,.00
and one month's rent of $425.00. Defendants also agreed to pay a pet deposit of
$200.00. (See attachment A paragraph 10).
6. Since July 25, 2000 the Defendants have resided continuously at the property
and have made no further payments on the lease. On September 20, 2000, Plaintiffs
filed an action before the District Justice for possession and back rent due on the
property.
7. On September 29,2000, the Honorable Helen B. Shulenberger filed a Judgment
in the amount of $874.38 against Defendants for back rent and costs, and ordered that
possession of the property be returned to Plaintiffs.

8. On October 10, 2000, Defendants filed a Notice of Appeal from the District
Justice Judgment.
II 9 On October 16, 2000, Plaintiffs filed a Complaint in the Court of Common Pleas
. of Cumberland County,
10. Since the date of that Complaint, Defendants have continued to reside at the
property and refuse surrender possession.
THEREFORE, Plaintiffs request that this Honorable Court enter an Order
granting possession to the Plaintiffs and finding damages in the amount of $1 ,600.00 for
rent from October 24, 2000 through November 15, 2000, late fees in the amount olf
$150.00, a pet deposit of $200.00, reasonable costs and attorney fees all provided for in
i the lease heretofore attached as Attachment A.

NEW MATTER
I. Breach of the Imolied Warrantv of Habitabilitv
11. Defendants repeat and incorporate by reference their averments set forth above in
Paragraphs 1 through 10.
12. Before they assumed occupancy of the premises, Defendants observed the following
defects, which Plaintiffs agent, Kathleen Darius, promised to remedy promptly: a seeping
chimney which needed to be capped; missing outlet covers and light switch covers; the absence
of a barrier which separated the crawl space from the living area of the residence; a faulty kitchen
faucet which sprayed water out of the sink; and moldy bathroom walls.
13. The first night that Defendants occupied the residence, and on several occasions
thereafter, they observed bats inside the dwelling which had entered through the chimney, and
had to expend $53.00 to remove one of the bats from the kitchen.
14. Despite being aware of the seeping chimney and the bat situation, Plaintiff did not
have the chimney capped until in or about the first week in September, 2000.
15. Plaintiff did not replace the missing outlet covers and light switch covers until on or
about September 9, 2000.
16. Soon after they moved in, and throughout their tenancy, Defendants noticed a foul
odor within the residence, which became more pronounced, and intolerable, at the beginning of
September, 2000.

17. On or about September 19, 2000, Defendants discovered that the odor Was caused by
a broken drain pipe from which raw sewage was flowing into the crawl space beneath the
residence.
18. After being informed of this problem, Plaintiff repaired the drain pipe, but failed and
refused to remove the sewage which had accumulated in the crawl space, the odor from which
continued to permeate the residence.
19. Plaintiff never installed a barrier between the living area and the crawl space, which
contributed to the foul odor within the residence.
20. The wiring in the residence is defective and poses a fire hazard.
21. Plaintiff did not install or furnish spoke detectors or a fire extinguisher until on or
about October 14,2000.
22. Throughout their tenancy, the rental premises was infested with roaches, silverfish,
and other insects, resulting in Defendants' children receiving numerous insect bites, some of
which required medical attention.
23. Throughout Defendants' tenancy, there were leaks from the bathroom which dripped
into the room below, a problem of which Plaintiff was aware but failed to remedy.
24. Plaintiff never repaired the kitchen faucet or provided Defendants with material to
paint the bathroom walls, as Plaintiffs agent had promised before Defendants assumed
occupancy of the premises.
25. Plaintiff was informed of the above-described defects, but either failed to remedy
them at all or failed to remedy them in a seasonable manner after having a reasonable opportunity
to do so, in breach of the implied warranty of habitability.
26. Defendants' use of the rental premises was substantially reduced by the above-

27. Because of said defects, the rental premises was unsafe, unhealthy and unfit for
human habitation, and had significantly reduced rental value or no rental value whatsoever.
28. Because of Plaintiffs breach of the implied warranty of habitability, Defendants did,
and were entitled to, withhold rent from Plaintiff, and do not owe Plaintiff any rent.
II. Late Fee Provision in Lease is Unenforceable
29. The late charges assessed under Paragraph 5 of the parties' lease, consisting of a
$50.00 late fee if the rent is not paid by the 30th of the month, are unconscionable, excessive, bear
no reasonable relationship to any losses Plaintiff may incur as the result of the late payment of
rent, and are unenforceable as a penalty.
III. Attornev's Fees Provision in Lease is Unenforceable
30. The attorney's fees provision of the parties' lease (Paragraph 25), is unconscionable
and unenforceable, as it consists of boilerplate language not subject to negotiation by Defendants,
whose bargaining power was grossly inferior to Plaintiff s; provides for the award of attorney's
fees to the Plaintiff only, regardless of the respective merits ofthe parties' claims or defenses;
and is contrary to the "American Rule" that each party is responsible for it's own attorney's fees.
IV. Absence of Damages from Pets Renders Pet DeDosit Uncollectable
31. Because Defendants' pets caused no damage to the rental premises, Plaintiff is not
entitled to the pet deposit.
V. Security DeDosit Offsets Plaintiffs Claims
32. Before Defendants assumed occupancy ofthe rental premises, they paid Plaintiff a

ANSWER TO DEFENDANTS NEW MATTER
12. Denied. None of the Specific defects with the exception of misSing outlet
covers and light switch covers were brought to the attention of Plaintiffs agent,
Kathleen Darius. Plaintiffs promptly replaced the outlet and light switch covers (see
exhibit A). On the weekend of August 26, the apartment was sprayed for bugs, a
new refrigerator and an electric stove was installed in the apartment and all carpets
were shampooed prior to the Defendants assuming occupancy of the premises (see
exhibits B, C, & D).
13. Admitted in Part and Denied in Part. It is admitted that the Defendants
complained of bats in the apartment on August 17, 2001. It is denied the
Defendants "had to expend $53.00 to remove one of the bats' in that Defendants
did not seek approval or repairs through the Plaintiff as is required in the lease,
Plaintiffs agents put a cover on the hole on the inside of the apartment to keep bats
out and a chimney cap was installed on the premises.
14. Denied. It is Plaintiffs recollection that the cap was placed on the chimney
sometime near the end of August, and so that time the inside chimney cap wa~j
place to prevent bats from invading the premises.
15. Denied. Plantiffs authorized their agent to replace missing outlet covers
and light switch covers on August 3, 2000 (see exhibit A).
16. Denied. No mention of fowl odor inside the residence was brought to the
Plaintiffs attention until the 18 or 19 of September 2000. The Plaintiffs denied that
there was a foul odor, having done and inspection on the apartment on August 26,
2000, the only noticeable odor in the premises was a dog odor.

17. Denied. On September 18,2000, Plaintiffs discovered that a sewer pipe
had broken. The pipe was repaired the following day on August 19, 2000.
18. Admitted in Part and Denied in Part. It is admitted that the Plaintiffs
properly repaired the drain pipe, however, Plaintiff was informed by its agent,
Peck's Septic, that any remaining materials in the crawl space could not be pumped
out and would have to covered with lime once the area dried up.
19. Denied. Plaintiffs attempted to install an area between the living area and
the crawl space however the Defendant refused to allow repair personnel to enter
the apartment telling them in was inconvenient even though prior arrangements had
been made for the repairs to be made ona certain date.
20, Denied. Harold Souders of Souders Electric and Plumbing did not find
any problems with the wiring nor did he say that it was unsafe or defective, upon
inspection of the property.
21. Denied. A smoke detector existed in the dining area of the apartment
before the Howell's moved in. Upon notice from the Defendants, smoke detectors
and fire extinguishers were provided to the Defendants.
22. Denied. After reasonable inspection of the properties and reasonable
attempts to remove any insect problems, Plaintiffs saw only two or three dead
roaches in apartment 4, did not see any in apartment 1 or 3 and did not check
apartment 2 after spraying. Plaintiffs did not see any silverfish or "other insectSi".
Defendants never produced any doctor bill for children with insect bites.
23. Denied. Plaintiffs do not recall of the Defendants informing them on any
leakage problem in the bathroom. Upon inspection of the bathroom the Plaintiffs
discovered that Defendants were careless with shower water which could have
drained out and caused ceiling tile downstairs to get wet.
24. Denied. Plaintiffs were never informed with any problems with the kitl:hen
faucet or a requirement for paint. The Defendants inspected the apartment with Mr.
Wall, Plaintiffs agent, and seemed happy with the property.
25. Denied. Plaintiffs have substantial records to demonstrate that any
problems raised by the Defendants were remedied in a seasonable matter.

26. Denied. Defendants never suffered a substantial reduction of the use of
the premises by alleged defects that may have existed.
27. Denied. The rental premises were not unsafe, unhealthy or unfit for
human habitation. The apartment had been rented for a year immediately before
Defendants and the previous tenants did not complain of any problems.
28. Neither admitted nor denied. This paragraph states a conclusion of law to
which to response is required.
II. Late Fee Provision of Lease is Unenforceable
29. Neither admitted nor denied. The allegations in paragraph in 29 call for a
conclusion of law to which no response of pleading is required.
III. Attorney's Fees Provision of Lease is UnenforceablEI
30. Neither admitted nor denied. The allegation in paragraph in 30 call for a
conclusion of law to which no response of pleading is required.
IV. Absence of Damages From Pet Renders Pet Deposit is
Uncollectable
31. Denied. It is a provision of the Pet Agreement in the Lease to collect ,8
deposit from tenants who have pets. Defendants never paid the pet deposit.
Plaintiffs alleged that the Defendants pet did cause and is prepared to raise suc;h
issues at trial.
V. Security Deposit Offsets Plaintiffs Claims
32. Denied. Security Deposit is required to set aside for damages done t<<::> the
property by the tenants. Plaintiff avers and alleges that $425.00 will not cover
damages and cleanups and loss of income for the months that the Defendants did
not pay rent.
