The pertinent information concerning the child who is the subject of this litigation is as follows: NAME DATE OF BIRTH CURRENTLY IN THE CUSTODY OF Tyler Hummel January 16, 1999 Father 2. A Custody Conciliation Conference was held on March 26, 2002, in respons(~ to Father's Petition to Modify Custody filed on or about February 20, 2002. Present for th(~ conference were the Father, Steven Hummel, and his counsel, Linus E. Fenicle, Esquire; the Mother, Courtney Bowen, did not appear. 3. At the time of the Custody Conciliation Conference, Mr. Fenicle presented Courtney's Mother, Judy Bushey, to verify that she had seen her daughter, Courtney Bowen, most recently on March 13,2002 and that Courtney had made reference to havin~l receive the information about the Conference in themail.Mr. Fenicle indicated that it was Mrs. Bushey that had provided him with a mailing address for Courtney. Counsel for Father represents that Mother has recently been incarcerated in Cumberland County Prison for nonpayment of child support. Neither Father nor the maternal grandmother, Judy Bushey, know where Mother is presently residing. The maternal grandmother has had no contact with Ms. Bowen for the period from October 31,2001 through on or about March 13, 2002. Father represents that Courtney has had little to no contact with the child since September 20, 2001. Father continues to allow the maternal grandmother to use the time provided to Courtney in the present custodial Order. Neither the maternal grandmother nor the Father have a telephone number for Courtney. 4. The Custody Conciliator is satisfied that Father has reasonably attempted to effect service of the Order scheduling a Custody Conciliation Conference upon the Mother ~'. - I 'L ,. .... ,"""" V"'~' ~,""":~-J' and will recommend a temporary Order in the form as requested by Father while imposing the requirement upon Father's counsel to make reasonable attempts to locate Mother and serve her with a copy of the Order and making it clear in the language of the Order that Mother is free to seek a modification of the Order if she is aggrieved by its terms. 5. The parties were seen for an emergency Custody Conciliation at the request of counsel for the Father. Father reports that he has had reports that Mother was in contact with a mutual acquaintance over the weekend of November 18 and 19, 2000, wherein Mother allegedly asked to be allowed to stay at this acquaintance's home because she reportedly had no place to stay that weekend, Father is concerned because this was Mother's custodial weekend and the temperatures had dropped very low at night. Father is concerned that if Mother has inadequate housing, that periods of overnight custody with Mother are unsafe for the minor Child. Father is also concerned that there have been frequent and numerous job and relationship changes in Mother's life which raises concern about the stability of Mother' life style. 4, Mother denies that she was without housing the weekend of November 18 and 19, 2000, She admits that she did not stay at home the night of November 18c 2000 because the child had fallen asleep about 11 :00 p.m. and she did not want to wake him to drive home, 5, The parties reached an agreement in the form of an Order as attached. j~~. A Custody Conciliation Conference was held on March 26, 2002, in response to Father's Petition to Modify Custody filed on or about February 20, 2002. Present for the conference were the Father, Steven Hummel, and his counsel, Linus E. Fenicle, Esquire; the Mother, Courtney Bowen, did not appear. 3. At the time of the Custody Conciliation Conference, Mr. Fenicle presented Courtney's Mother, Judy Bushey, to verify that she had seen her daughter, Courtney Bowen, most recently on March 13,2002 and that Courtney had made reference to havin~l receive the information about the Conference in themail.Mr. Fenicle indicated that it was Mrs. Bushey that had provided him with a mailing address for Courtney. Counsel for Father represents that Mother has recently been incarcerated in Cumberland County Prison for nonpayment of child support. Neither Father nor the maternal grandmother, Judy Bushey, know where Mother is presently residing. The maternal grandmother has had no contact with Ms. Bowen for the period from October 31,2001 through on or about March 13, 2002. Father represents that Courtney has had little to no contact with the child since September 20, 2001. Father continues to allow the maternal grandmother to use the time provided to Courtney in the present custodial Order. Neither the maternal grandmother nor the Father have a telephone number for Courtney. 4. The Custody Conciliator is satisfied that Father has reasonably attempted to effect service of the Order scheduling a Custody Conciliation Conference upon the Mother - ~'- .
