COMPLAINT
AND NOW, comes the Plaintiff, Marshall B. Sacks, C.P.A., by and through his
attorneys, Butler Law Firm, and files this Complaint against Defendant, Integrated Electrical
Services, Inc., and in support thereof avers as follows:
1. The Plaintiff, Marshall B. Sacks, C.P.A., is a sole proprietorship with his principal
place of business at 200 Hidden Valley Lane, Harrisburg, Pennsylvania 17112.
2. The Defendant, Integrated Electrical Services, Inc., is a corporation registered to
do business in the Commonwealth of Pennsylvania with its principal place of business at 211
Bailey Street, New Cumberland, Pennsylvania 17070,
3. From November 1995 through on or about June 10, 1998, Plaintiff performed
various accounting services for Defendant and Robert E. Hurley, President of Defendant.
4. Defendant has failed and refused to pay the balance due on four (4) outstanding
invoices to Plaintiff for the services described therein as follows:

a. Invoice dated December 30, 1995, for professional services rendered in
November and December, 1995, in the amount of$350.00. A true and correct copy of said
Invoice is attached hereto and made a part hereof as Exhibit "A".
b. Invoice dated February 1, 1996, for professional services rendered in January,
1996, in the amount of $330.00. A true and correct copy of said Invoice is attached hereto and
made a part hereof as Exhibit "B".
c. Invoice dated February 29, 1996, for professional services rendered in February,
1996, in the amount of$750.00. A true and correct copy of said Invoice is attached hereto and
made a part hereof as Exhibit "C".
d. Invoice dated April 2, 1996, for professional services rendered in the amount of
$125.00, A true and correct copy of said Invoice is attached hereto and made a part hereof as
Exhibit "D".
5. Plaintiff also represented Defendant in an Internal Revenue Service audit by
Examiner, Thomas L. Kurtz, in or about March, 1998, through June 10, 1998, as part ofa
continuing business relationship with Defendant. True and correct copies of correspondence and
documents in connection with said audit are attached hereto and made a part hereof as Exhibits
"E".
6. Plaintiff provided to Defendant the services described in the invoices,
correspondence and documents attached hereto in a timely and workmanlike manner.

due and owing to Plaintiff in the amount of$I,555,00 plus costs of filing and serving a District
Justice complaint in the amount of$80,50,
WHEREFORE, Plaintiff, Marshall B. Sacks, C.P .A, respectfully requests this Honorable
Court to enter judgment for Plaintiff and against Defendant, Integrated Electrical Services, Inc.,
in the amount of$I,635,50 plus interest and costs of this suit and grant all such other relief as it
proper and just

Admitted that Defendant is a corporation registered to do business in the Commonwealth
of Pennsylvania. Denied that the principal place of business is 21 1 Bailey Street, New
Cumberland, Pennsylvania. On the contrary, the principal place of business for the
Defendant is 2221 Mockingbird Road, Harrisburg, Dauphin County, Pennsylvania.

Admitted that Plaintiff performed various accounting services for Defendant. Denied that
said accounting services were performed through June 10, 1998. On the contrary,
Plaintiff's services for Defendant stopped in February 1996. By way of further answer,
any services done for Robert E. Hurley were not done for Defendant Integrated Electrical
Services, Inc.

payable. Furthermore, by way of further answer, Defendant asserts that the April 2,
1996 invoice to Robert E. Hurley listed as Exhibit "D" of Plaintiff's Complaint is not a
proper debt owing by the Defendant.

Denied. It is denied that Defendant had a continuing business relationship with Plaintiff
beyond February 1996. Any communication Plaintiff had with the Internal Revenue
Service as set forth on Exhibit "E" of Plaintiff's Complaint were not done with the
permission or authorization of Defendant, and were not done pursuant to any request of
the Defendant, and was not done pursuant to any continuing business relationship Plaintiff
allegedly had with the Defendant.

Denied. The invoice attached as Exhibit "C" is not a proper invoice that may be
submitted to the Defendant in that it is work done for Robert E. Hurley.

Plaintiff's claim is barred by the applicable four year statute of limitations on the basis that
Plaintiff's claim was filed more than four years after February 1996.

AND NOW, comes the Plaintiff, Marshall B. Sacks, C.P.A., by and through his
attorneys, Butler Law Firm, and files this Reply to Defendant's New Matter, and in support

from March, 1998 to June 10, 1998, Defendant retained the services ofC.P.A., James Smeltzer,
of Seligman Friedman and Company, P .C. Elizabeth Hurley, former president of Defendant,
authorized the Plaintiff to represent Defendant in connection with an IRS audit of Defendant.
During this period, Mr. Smeltzer and Plaintiff participated in meetings pertaining to Defendant
