AND NOW comes the above Plaintiff, Wilbur E. Raudabaugh, by his attorney, Cara A.
Boyanowski, Esquire, and seeks to obtain a decree in divorce from the above-named Defendant, upon
the grounds hereinafter set forth:
1. The Plaintiff, WilburE. Raudabaugh, Social Security number 203-10-5753, is an adult
individual with a who resides at 205 Westview Drive, Mechanicsburg, Cumberland County,
Peunsylvania 17055.
2, The Defendant, Helen L. Raudabaugh, Social Security number 193-24-2403, is an
adult individual who is believed to be residing with her daughter, at Wolf Run, New Cumberland,
Cumberland County, Pennsylvania 17070.
3. The Plaintiff and Defendant are sui juris, and both have been bona fide residents of the
Commonwealth ofpennsylvania for a period of more than six months inunediately preceding the filing
of this Complaint.

4. The Plaintiff and Defendant were married on November 15, 1982, in Enola,
Cumberland County, Pennsylvania,
5. Neither Plaintiff nor Defendant is in the military or naval service of the United States
or its allies within the provisions of the Soldiers' and Sailors' Civil Relief Act ofthe Congress of 1940
and its Amendments.
6. The cause(s) of action and section(s) of Divorce Code under which Plaintiff is
proceeding are:
A. Section 3301(c). The marriage of the parties is irretrievably broken.
After ninety (90) days have elapsed from the date of the filing of this Complaint,
Plaintiff intends to file an Affidavit consenting to a divorce. Plaintiff believes that
Defendant may also file such an Affidavit.
B. Section 3301(d). The marriage of the parties is irretrievably broken.
The Plaintiff and Defendant separated on September 13, 2000.
7. There have been no prior actions in divorce between the parties.
8. Plaintiff has been advised of the availability of counseling and that Plaintiff may have
the right to request the parties to participate in counseling.
9. The parties may enter into a written agreement with regard to property division. In
the event that such an agreement is executed by the parties, the agreement may be incorporated by
the Court into the final Decree of Divorce.
WHEREFORE, Plaintiff requests your Honorable Court to enter a Decree in Divorce,
divorcing Plaintiff and Defendant.

11, Plaintiff and Defendant have acquired property, both real and personal during their
marriage from the date of their marriage, November 15, 1982, until the date of their separation,
September 13, 2000.
12. Plaintiff and Defendant have been unable to agree as to an equitable division of said
property,
WHEREFORE, Plaintiff requests your Honorable Court to equitably divide all marital
property,

14, Plaintiff and Defendant are the owners, as tenants by the entireties, of real property
located at 205 Westview Drive, Mechanicsburg, Cumberland County, Pennsylvania. This property
was the marital residence of the parties,
15. Since Defendant voluntarily vacated the marital residence on September 13, 2000, this
residence has been the only home of Plaintiff.

16, Since the separation of the parties, it is believed that Defendant has come to the
residence, with her grown children, stalked Plaintiff, and attempted to enter the house after dark.
17. Defendant's conduct is upsetting to Plaintiff, invades his privacy, and disrupts his sense
of security.
18. Plaintiff desires to continue residing in the real property, located at 205 Westview
Drive, Mechanicsburg, Cumberland County, Pennsylvania, to the exclusion of Defendant.
WHEREFORE, Plaintiff requests your Honorable Court to grant him exclusive possession
of the marital residence.
