COMPLAINT
AND NOW comes Plaintiff, SuperPetz, II, Inc., by and through its attorneys of
record, Mette, Evans & Woodside, and hereby brings this Complaint against
Defendant, C&N Western Outfitters, Inc. and avers as follows:
1. Plaintiff, SuperPetz II, Inc. (hereinafter "SuperPetz") is a Pennsylvania
corporation doing business at 2880 Bergy Road, Hatfield, Pennsylvania, and is a
subsidiary of We is Markets, Inc.
2. Defendant, C&N Western Outfitters, Inc. (hereinafter "C&N"J, based
on information and belief, is a Pennsylvania corporation last known to be doing
business at 4833 Carlisle Pike - Rear, Mechanicsburg, P A 17055
3. SuperPetz and C&N are parties to a written lease agreement, dated
December 16, 1996 (hereinafter "Agreement"J. A copy of the Agreement is attached
hereto as Exhibit "A"
4. The Agreement provides that C&N is to pay SuperPetz $1,125.00 per
month for rental of commercial property (hereinafter "the Premises"). See Exhibit

"A," page 1, paragraph 1.
5. The Agreement provides that the lease shall terminate upon 20 days
written notice:
"All of your rights in and to the Premises shall terminate upon twenty
(20) days written notice from SuperPetz to you. It is specifically
understood that this is not a month to month arrangement, but may be
terminated by SuperPetz at any time upon said twenty (20) days notice.
You agree that in the event said twenty (20) days notice is given, any
personal property or fixtures belonging to Tenant and remaining within
the Premises shall be deemed abandoned. SuperPetz may then enter
into the Premises and take possession of any such personal property or
fixtures and remove such items from the Premises and dispose of them.
You hereby waive all claims to such abandoned personal property or
fixtures and SuperPetz may dispose of such abandoned personal
property or fixtures at its sole discretion."
See Exhibit "A," page 2, paragraph 4.
6. In 1997, C&N failed to make several rental payment to SuperPetz.
7. By letter dated May 6,1997, SuperPetz notified C&N that C&N was to
vacate the Premises no later than May 31, 1997 and that any property remaining on
the Premises after that date would be considered abandoned. A copy of this letter is
attached hereto as Exhibit "B."
8. By letter dated May 30, 1997, C&N insisted that it be given until June
30, 1997 to vacate the Premises. A copy of this letter is attached hereto as Exhibit
"C."
9. Based upon information and belief, C&N vacated the Premises in late
June, 1997.
10. Upon vacating the Premises, C&N left behind several items of

inventory, which, based upon information and belief, are owned by C&N. To date,
this inventory remains on the Premises.
11. C&N has failed to pay rent to SuperPetz for the months of May, 1997
and June, 1997.
12. SuperPetz has made demands upon C&N for payment of the past due
rent.
13. SuperPetz has made demands upon C&N regarding the abandoned
inventory, including demands for the payment of reasonable storage fees.
14. To date, C&N has failed to pay SuperPetz rental for the months of May,
1997 and June, 1997 and has not paid SuperPetz storage fees for the inventory
remaining on the rental property.
COUNT I
BREACH OF CONTRACT
15. Paragraphs 1-14, above, are hereby incorporated by reference as if fully
set forth.
16. The Agreement provides that C&N pay to SuperPetz a monthly rental
of $1,125.00.
17. C&N has failed to pay rent for the months of May, 1997 and June, 1997,
and rent for these months remains outstanding.
18. SuperPetz has made repeated demands upon C&N for the payment of
such rent.

19. Upon vacating the premises, C&N left behind several items of
inventory, which SuperPetz has had to maintain due to C&N's conduct.
20. SuperPetz is entitled to the reasonable costs of storage for the
aforementioned inventory.
WHEREFORE, Plaintiff SuperPetz II, Inc. respectfully requests that this
Honorable Court enter judgment in its favor and against Defendant C&N Western
Outfitters, Inc. for an amount exceeding the jurisdictional limits for compulsory
arbitration, representing the reasonable cost to SuperPetz for rental of commercial
property for two months and storage ofC&N Western Outfitters, Inc.'s inventory for
approximately three years, plus such costs and other relief that this Honorable Court
deems appropriate.
COUNT II
UNJUST ENRICHMENT
21. Paragraphs 1-20, above, are hereby incorporated by reference as if fully
set forth herein.
22. C&N benefitted by occupying the commercial rental property.
23. SuperPetz stored C&N's inventory from July 1, 1997 to the present
time, conferring an additional benefit upon C&N.
24. SuperPetz reasonably expected payment from C&N for such benefits.
25. C&N has not made payment to SuperPetz for such benefit, despite
demands from SuperPetz.
26. The reasonable value of rental for the aforementioned commercial

property is $1,125.00 per month.
27. The reasonable value of storage fees for the aforementioned inventory is
$973.00 per month.
WHEREFORE, PlaintiffSuperPetz II, Inc. respectfully requests that this
Honorable Court enter judgment in its favor and against Defendant C&N Western
Outfitters, Inc. for an amount exceeding the jurisdictional limits for compulsory
arbitration, representing the reasonable cost to SuperPetz for rental of commercial
property for two months and storage of C&N Western Outfitters, Inc.' s inventory for
approximately three years, plus such costs and other relief that this Honorable Court
deems appropriate.
