Roadcap and Elaine Roadcap are husband and wife who currently reside at 30 West Keller Street, Mechanicsburg, Cumberland County, Pennsylvania. 2, Defendant Mike Peters is an adult individual who currently resides at 30 Emlyn Lane, Mechanicsburg, Cumberland County, Pennsylvania, 3. On August 22, 1998, the date which gives rise to the facts supporting this claim, the defendant Mike Peters resided at 37 West Simpson Street, Mechanicsburg, Pennsylvania and his backyard abutted the same alleyway as the backyard of the plaintiffs. 4. Plaintiffs are the owners of a black Labrador named "Mandy" and on August 22, 1998 plaintiff Elaine Roadcap was walking her dog in the alleyway that separated the plaintiffs' property from the defendant's property. 5. While walking past the defendant's garage at the rear of defendant's property the defendant's dog, a Dalmatian, suddenly and without warning rushed out of the garage and attacked Mandy and caused serious injuries to Mandy's left side and left leg. Plaintiffs commenced the above-captioned matter on or about November 2, 2000. 2. The facts and circumstances alleged in Plaintiffs complaint are associated with alleged injuries and damages sustained by Plaintiffs' pet dog. 3. A dog is personal property. I. PRELIMINARY OBJECTION IN THE NATURE OF A DEMURRER PURSUANT TO Pa.R.C.P. l028la)l4) 4. paragraphs 1 through and including 3 are incorporated herein by reference as if set forth at length. 5. No cause of action exists for alleged damages sustained to a dog by another dog. 7. No cause of action exists for alleged out of pocket expenses associated with alleged medical or veterinary treatment sustained to a dog by another dog. 8. Plaintiffs complaint fails to allege the value of the dog. WHEREFORE, Defendant respectfully requests that this Honorable Court dismiss Plaintiffs' Complaint with prejudice and enter judgement in favor of Defendant on all counts, or in the alternative, require Plaintiffs to file an amended pleading. I. PRELIMINARY OBJECTION IN THE NATURE OF MOTION TO STRIKE FOR LACK OF CONFORMITY TO LAW OR RULE OF COURT PURSUANT TO Pa.R.C.P. l028(a)(2) 9. paragraphs 1 through and including 8 are incorporated herein by reference. 10. Plaintiffs' Complaint seeks damages in the amount of $3,093.50 for alleged injuries to Plaintiffs' dog as alleged in Paragraph 13. 11. Plaintiffs Complaint seeks damages for out of pocket- expenses in the amount of $587.20 for alleged medical or veterinary treatment provided to Plaintiffs' dog as alleged in paragraph 14. 12.
