· 2003, by
and between W. LEE ROLAND, BUILDER, of 104 Lavynndon Lane,
Mechanicsburg, Pennsylvania, hereinafter referred to as
Contractor· AND CLIFFORD H. EVENS, III and TRACY LEE EVENS,
husband and wife, of 10 Canterbury Court, Mechanicsburg,
Pennsylvania, hereinafter referred to as Owner, whereby the
former undertook and agreed to erect and construct a residential
dwelling on that certain lot of ground situate in Silver Spring
Township, Cumberland County· Pennsylvania, being Lot No. 27,
Final Subdivision Plan for Hillside Farms, Phase II, dated
September 17, 1998, last revised June 23, 2000, said plan being
recorded in Plan Book 81, Page 67. Being part of the same
premises which W. Lee Roland and Rosalie H. Roland, husband and
wife, by Deed dated January 17, 2003 and recorded January 22,
2003 in the Cumberland County Recorder of Deeds Office in Deed
Book 255, Page 2228, granted and conveyed unto Clifford H. Evens,
III and Tracy Lee Evens. Also being the same premises which
Hempt Realty, Ltd., a Pennsylvania limited partnership, by Deed
dated April 20, 2001 and recorded April 26, 2001 in the
Cumberland 'Recorder of Deeds Office in Deed Book 243, Page 489,
granted and conveyed unto W. Lee Roland and Rosalie H. Roland,
husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
