WEARY 1850 Pine Rtl., Newville, PA 17241 day of April, 2003, by and between hereinafter referred to as Contractor, AND BRETT A. ICKES and AMY L. ICKES, 8 Liberty Drive, Mt. Holly Springs, PA 17065 hereinafter referred to as Owner, Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in South Middleton Township, Cumberland County, Pennsylvania, being known as Lot 22 of a Proposed Re-Subdivision Plan for Yorkfield and recorded in Cumberland County Plan Book 81, Page 28. Being further identified as Tax Parcel No. 40-11-0288-088 NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Fisher, P.L.S., of Fisher, Mowery, Rosendale & Associates, Inc., dated January 27, 1999, and recorded in Cumberland County Plan Book 81, Page 28. BEGINNING at a point along the centerline of Old York Road (S.R. 0174) at the line of lands now or formerly of Donald H. Goodyear Trust; thence along said line of Iands now of formerly of Donald H. Goodyear Trust, North 15 degrees 15 minutes 52 seconds West 366.52 feet to a point; thence along the dividing line between Proposed Lot No. 21 and Proposed Lot No. 22, North 85 degrees 33 minutes 42 seCOnds East 368.84 feet to a point; thence continuing along the same South 04 degrees 26 minutes 18 seconds East 360.00 feet to a point; thence along the centerline of Old York Road (S.I~ 0174), South 85 degrees 33 minutes 42 seconds West 300.00 feet to a point, the place of BEGINNING.
