COMPLAINT
AND NOW comes the Plaintiff, by and through its attorneys, the Offices of
Fenstermacher and Associates, P.C., and files this Complaint, as follows:
1. Plaintiff Jeffrey A. Wilbur Plumbing & Heating, Inc. ("Wilbur") is a
Pennsylvania corporation in good standing with an address for conducting business at
6508 Brandy Lane, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendants James Diana and Victoria Diana, husband and wife Oointly
"the Dianas"), are adult individuals currently residing at 183 Faith Circle, Carlisle,
Cumberland County, Pennsylvania.
3. The Dianas trade and do business as Hunter's Run Construction, a
fictitious name the Dianas registered on August 29, 1997.
4. In or about September of 1999, Wilbur performed services for the
Defendants at one of Defendants' construction sites located at 144 North Spring Garden
Street in Carlisle, Pennsylvania (hereinafter "the Property").
5. Defendants, general contractors, were in the process of constructing a
single family home on such property.

6. On September 28, 1999, Wilbur presented a proposal to the Defendants
setting forth the work that was to be performed on the Property. Said proposal is
attached and incorporated herein as Exhibit "A".
7. The proposal was initially to do work priced in the amount of $5,679.00;
however, that proposal was subsequently reduced to $4,179.00 based upon
Defendants' desire to not have Wilbur install fixtures and faucets.
8. Upon commencing the work, Wilbur's employees were requested by the
Defendants to provide additional material and services not contemplated under the
initial proposal.
9. Based upon Defendants' requests, a change order was issued on March
14,2000, memorializing the additional materials and services to be provided at the price
of $179.37. Said change order is attached and incorporated herein as Exhibit "B".
10. Immediately upon commencing work on the project, the Dianas,
particularly James Diana, made statements to Wilburs' employees that he believed that
the initial proposal was too high and that he had no intention of paying Wilbur for the
work performed.
11. James Diana further stated that if Wilbur wanted him to pay, that Wilbur
would have to sue him.
12. James Diana further inquired of Wilbur's employees as to whether they
would do side work for him, rather than having to pay Wilbur to do such work.

13. The work was done in- a reasonable and workmanlike manner and was
completed in or about March, 2000.
14. Invoices were sent on March 14 and March 17,2000, setting forth the
amount due for the work provided.
15. As no payment was received on April 7, 2000, Wilbur contacted the
Dianas to request payment.
16. At that time, James Diana stated his displeasure with the work performed
by Wilbur and his demand that additional work and/or redoing of the original work was
required. At no time prior to this conversation did the Defendants ever raise an issue as
to the workmanship being performed at their construction site.
17. On April 7, 2000, Jeffrey Wilbur discussed with James Diana the matters
that Mr. Diana believed were required to fulfill the obligations of Wilbur under the
agreement.
18. On April 7, 2000, Jeffrey Wilbur met with James Diana on the construction
site, toured the entire house and discussed the issues that Defendants believed needed
to be addressed.
19. On April 17, 2000, Wilbur provided to the Defendants a written
memorialization of the issues that were discussed at the job site. In particular, Wilbur
set forth the items that the Defendants deemed unacceptable and the steps and actions
that Wilbur would take, at no cost to the Defendants, to remediate those concerns.

20. The matters requested by the Defendants and agreed upon by Wilbur
went above and beyond either what was required under the initial proposal and change
order and that which would be reasonably required by any local permitting body.
21. The Defendants refused to allow Wilbur to remediate the various
overstated concerns of the Defendants and refused to allow Wilbur, its agents or
employees to return to the property to make such remediations.
22. Upon information and belief, James Diana, though not licensed to do so
and in violation of Carlisle Borough Ordinances, made changes and alternations to the
plumbing work performed by Wilbur.
23. As of the date of this Complaint, the Defendants continue to fail and refuse
to pay the material and services provided.

BREACH OF CONTRACT
24. Paragraphs 1 through 23 are incorporated fully herein by reference.
25. Wilbur provided the services and material in a reasonable and
workmanlike manner and performed all of its duties and obligations under the contract.
26. Defendants have failed and continue to fail and refuse to make payment
for such material and services.
WHEREFORE, Plaintiff Jeffrey A. Wilbur Plumbing & Heating, Inc. respectfully
requests this Honorable Court enter judgment for it and against the Defendants in the
amount of $4,358.00 and further award all pre-judgment interest, post-judgment interest

and all other relief deemed fair and equitable. Such amount is lower than the statutory
threshold and therefore requires compulsory arbitration.
COUNT II
UNJUST ENRICHMENT
27. Paragraphs 1 through 26 are incorporated fully herein by reference.
28. Wilbur provided services and materials to the Defendants in a reasonable
and workmanlike manner.
29. Defendants accepted and have retained said materials and services and
have benefited by such retention.
30. It would be inequitable to allow the Defendants to retain said materials and
services without payment to Wilbur in the amount of $4,358.00 plus interest.
WHEREFORE, Plaintiff Jeffrey A. Wilbur Plumbing & Heating, Inc. respectfully
requests this Honorable Court enter judgment for it and against the Defendants in the
amount of $4,358.00 and further award all pre-judgment interest, post-judgment interest

AND NOW comes the Plaintiff, Jeffrey A. Wilbur, Plumbing and Heating, Inc. by
and through its attorneys, the Offices of Fenstermacher and Associates, and asserts

1. The above-captioned action is of issue.
2. The claim for the Plaintiff is $4,358.00, plus pre-judgment and post
interest, and all costs. Defendants' Counterclaim is for the amount of $5,875.00.

AND NOW, comes the Plaintiff, JAMES G. DIANA, tJd/b/a HUNTER'S RUN
CONSTRUCTION, by and through his attorney, Gregory H. Knight, Esquire, and files a Complaint,
and in support of which the following statements are made:
1. Plaintiff is James G. Diana, an adult citizen ofthe Commonwealth of Pennsylvania,
tJdlb/a Hunter's Run Construction, with a residence and a home construction business at 183 Faith
Circle, Carlisle, Cumberland County, Pennsylvania 17013.
2. Defendant is Wilbur Plumbing & Heating, Inc., a Pennsylvania corporation, with a
business address of6508 Brandy Lane, Mechanicsburg, Cumberland County, Pennsylvania 17055-
4758.
3. On or about September 28, 1999, Plaintiff accepted a written proposal from the
Defendant for the Defendant to complete the rough installation of sewer and water main connections
to a house being built by the Plaintiff at 144 North Spring Garden Street, Carlisle, Pennsylvania.
4. In March 2000, Defendant began the work it agreed to do but its employees failed to
complete the work in a satisfactory manner though throughout that time period Plaintiff frequently
noted deficiencies and improper workmanship to Defendant's employees and agents.
5. In April 2000, Plaintiff hired an inspection agency to document Defendant's
substandard performance. See Exhibit A.

6. On July 5, 2000 following an inspection of the Defendant's work, the Borough of
Carlisle sent Defendant an official Notice of Violation, by certified mail, that it had violated the
Plumbing Code of the Borough. See Exhibit B.
7. Defendant failed to respond to the Borough's Notice of Violation, forcing Plaintiff
to hire another contractor to complete the necessary plumbing and sewer work, including repair and
removal of substandard work.
8. Due to the extra time required to complete the work Defendant failed to perform,
Plaintiff could not complete closing settlement on July 31,2000, the date Plaintiff had contracted
for the home he was building at 144 North Spring Garden Street.
9. As a result of the Defendant's breach of contract, the Plaintiff spent 48 hours at
$40.00 per hour plus $955.00 in materials, a special permit, and an inspection (Exhibit A) to repair
and complete the work not done by the Defendant and the Plaintiffwas required to pay 4 months of
mortgage payments, totaling $3,000.00, to the property owner.
WHEREFORE, the Plaintiff requests that this Court award him damages of $5,875.00
together with counsel fees and such other relief as this Court deems appropriate.

1. Plaintiff served Interrogatories and Requests for Production of Documents
Upon Defendants on November 2, 2000, Such discovery requests are attached hereto
as Exhibit "A".
2. On February 8, 2001, the undersigned directed correspondence to
Defendants' counsel requesting that the long-overdue discovery responses be provided.
See Exhibit "B" attached hereto,
3. No response has been provided to either the outstanding discovery or
above-referenced correspondence.
4. Defendants' failure to provide answers to outstanding discovery is violative
of Pa, R.C,P. 4006(a)(2) and 4009,12(a)(1), and subject to sanctions pursuant to Pa.
R.C.P, 4019.

DEFINITIONS AND DIRECTIVES
The following request to produce is governed by the following definitions
and directives:
1. "You" and "your" shall mean Defendants, jointly or singularly, their
agents and employees.
2. "Document" shall mean all forms of recorded data or information,
including writings of any kind, including the originals and all non-identical copies,
whether different from the originals by reason of any notation made on such copies or
otherwise (including, without limitation, correspondence memoranda, notes, work
sheets, diaries, statistics, letters, telegrams, telex, telefax, minutes, contracts, reports,
studies, checks, statements, receipts, returns, summaries, pamphlets, books); notations
of any sort of conversations, telephone calls, meetings or other communications;
bulletins or printed matter of any type, and all forms of drafts, notations, workings,
alterations, modifications, changes or amendments of any of the foregoing; graphical or
oral records or representations of any kind (including, without limitation, photographs,
films, charts, graphs, videotapes, recordings, and motion pictures); and electrical
records or representations of any kind (including, without limitation, tapes, cassettes,
disks and recordings).
3. "Pertain to" shall be interpreted to include relating to, referring to,
reflecting, regarding, constituting, concerning or having as its subject matter, in any
manner whatsoever, directly or indirectly, expressly or implied, the subject matter of the
specific request.
4. "Communication" includes, but is not limited to, all written or oral
discussions, statements, conversations, memoranda, notations, letters, notices or any
document.
5, If any request for documents is deemed to call for production of
privileged or work product materials and such privilege or work product is asserted,
identify in writing each document so withheld. If only a portion of a document is
privileged or work product, then redact and identify such portion thereof that is withheld.
With regard to all documents or all portions of documents withheld, provide the following
information:
(a) The reason for withholding the documents;

1. The following Interrogatories are to be answered in writing, verified, and
served upon the undersigned within thirty (30) days of service upon you. Objections
must be signed by the attorney raising the objection. In answering, you must furnish
any and all information available to you, your employees, representatives, agents and
attorneys. Y{)ur answers must be supplemented and amended as required by the
Pennsylvania Rules of Civil Procedure.
2, With respect to any claim of privilege or immunity from discovery, you must
identify the privilege or immunity asserted and provide sufficient information to
substantiate the claim.
3. In lieu of identifying documents in response to these Interrogatories, you may
provide copies of such documents with appropriate references to the corresponding
Interrogatories.
4, These Interrogatories shall be construed and interpreted in accordance with
the Pennsylvania Rules of Civil Procedure.
Definitions
1. "Document", when used herein, means any record, including any object
which contains written, printed, typed or magnetically recorded information, a graphic or
photographic representation or sound, however produced or reproduced, Document
includes an original or any copy of any statement, report, letter, memorandum, book,
article, note, blueprint, drawing, sketch, photograph, motion picture, videotape,

2. "Identify" or "Identity", when used herein with respect to:
a. A natural person means to state:
i. the person's full name;
ii. the person's present or last known address; and
Hi. the person's employer and employer's address at the time of
the events referred to in the Interrogatory.

AND NOW come the Plaintiffs, by and through their attorneys, the Offices of
Fenstermacher and Associates, P.C., and files this Plaintiffs' Answers, as follows:
1. Admitted that James Diana is an adult individual residing at 183 Faith
Circle, Carlisle, Cumberland County, Pennsylvania.
2. Admitted.
3. Denied. Paragraph 3 refers to a written contract which terms speak for
themselves.
4. Admitted that Defendant completed work in March, 2000. It is denied that
such work was not performed in a satisfactory manner. It is further denied that Plaintiff
ever noted any deficiencies to the Defendants.
5. Admitted that Plaintiff hired an independent inspector. All other averments
relating to the inspection refer to a writing which speaks for itself.

6. Admitted that Borough of Carlisle issued correspondence dated July 5,
2000. Said letter is a writing which speaks for itself.
7. Denied: It is denied that Defendant failed to respond to the Borough
Notice of Violation. To the contrary, Plaintiff had refused Defendant access to the
property in April 2000, thereby prohibiting Defendant from curing any alleged violation.
8. Denied. It is specifically denied that Plaintiffs' inability to conduct closing
on the property was in any way the result of any action or inaction of the Defendant.
9. Denied. It is specifically denied that Defendant breached the contract in
any manner. It is further denied that Plaintiff incurred any cost or expense as a result of
the work perforrned by Defendant.
WHEREFORE, Counterclaim Defendant respectfully requests this Honorable
Court enter judgrnent for Counterclaim Defendant and against Counterclairn Plaintiff.
