ACTION OF EJECTMENT
COMPLAINT
First Union National Bank, Plaintiff, by and through its attorney, Anthony R. Distasio,
Esquire, of Linton, Distasio, Adams & Kauffman, P.C., brings this action of ejectment against the
Defendants and avers as follows:
I. First Union National Bank, Plaintiff, is a national bank organized under the laws of the
United States doing business at Two West Washington Street NJ 1212, Washington, NJ 07882.
2. The Defendants, Lee E. Vanasdlen and Sara E. Vanasdlen, are adult individuals whose
last known address is 319 Dwelling Court, Shippensburg, Cumberland County, Pennsylvania, and
, upon information and belief may have an occupancy interest in the subject property .
3. Upon information and belief the premises at II Hill Road, Carlisle, Cumberland
County, Pennsylvania may also be occupied by an unknown tenant and/or tenants
4. The Plaintiff purchased the premises known and numbered as II Hill Road, Carlisle,
West Pennsboro Township, Cumberland County, Pennsylvania, at Sheriff's sale on August 9, 2000. A
full description of the premises is attached hereto as Exhibit" A" and incorporated herein..
5. Plaintiff, First Union National Bank, has been the owner of the premises from the date
of the Sheriff Sale and still is the owner of the premises.
6. The deed evidencing the transfer of fee simple title to the Plaintiff, First Union
National Bank, by the Sheriff of Cumberland County, Pennsylvania, was recorded in the Office of the
Recorder of Deeds of Cumberland County on August ~4, 2000. A copy of said Deed is attached
hereto as Exhibit "B".
7. As of the date Plaintiff acquired title to the premises as a result of the Sheriff's sale,
the Defendants' interest became extinguished, terminated and void as a result of Plaintiff's purchase of

the premises, and therefore, the Defendants were and are unlawfully in possession of the premises
without right or authority of law.
8. Since that date and after demand by Plaintiff to vacate the premises, Defendants have
been in possession of the premises, and have at all times subsequent thereto withheld, and still do
withhold, the possession thereof from Plaintiff, all to Plaintiff's detriment.
WHEREFORE, Plaintiff demands judgment against the Defendants for possession of the
Property hereinbefore described, together with costs of the action and such other relief as may be
appropriate.

BEING the same premises which Ira E. Mell and Mabel M, Mell, his wife, by
their deed dated March 8, 1985, and recorded on March 8, 1985 in Book 31,1'age 436
in the Office of the Recorder of Deeds in and for Cumberland County Pennsylvania,
granted and conveyed unto Lee E. Vanasdlen and Sara E. Vanasdlen, his wife.

ALL THAT CERTAIN tract of land situated in Mt. Rock, Township of West
Pennsboro, County of Cumberland and Commonwealth of Pennsylvania, bounded and
described as follows, to wit:
BEGINNING at a stone; thence by land formerly of Sara Danner, now of Oren
Kitzmiller, South 31 degrees East 7.1 perches to a post; thence by land now or
formerly of Floyd Bitner, South 85 degrees West 7.5 perches to an apple tree (blown
down); thence by land formerly of Levi Mailor, now of Leib Myers, South 76 1/4
degrees West 20.3 perches to a post; thence by land formerly of John Seitz, now of
Earl Tritt, North 14 degrees West 8.7 perches to a post; thence by land formerly of
Levi Mailer, now of Earl Tritt, North 82 3/4 degrees East 25.5 perches to the Place of
BEGINNING.
CONTAINING one (I) acre and 70 perches, and having thereon erected a two
story brick house and outbuildings. LESS, HOWEVER, a piece of land 16 feet in
width along the West side of the above tract; containing 8.6 perches as the same is
fully described in deed from Caroline McKeehan to Abram Etter, dated June 13, 1916
and recorded in Deed Book "L", Volume 8, Page 447.
BEING the same pr~mises which Ira E. Mell and Mabel M. Mell, his wife, by
their deed dated March 8,f985, and recorded on March 8, 1985 in Book 31, Page 436
in the Office of the Recorder of Deeds in and for Cumberland County Pennsylvania,
granted and conveyed unto Lee E. Vanasdlen and Sara E. Vanasdlen, his wife.
