We have found it ever more difficult to schedule arbitration hearings by attempting to
telephone the offices of the attomeys and arbitrators to obtain advance clearance of dates, Most
recently, such efforts have been extremely time consuming and gotten to the point of futile,
Accordingly, we have developed a scheduling procedure similar to that followed by the American
Arbitration Association.
I am enclosing for each of you calendars for the months of October, November and
December, Kindly mark on those calendars with an "X" those mornings or afternoons when you
will be unavailable to attend the arbitration in the above referenced matter, Then, please return
the marked up calendars to me via the enclosed preaddressed envelope, so that I have them by
October 1, 2001,
In the event that I do not receive your calendar by that date, I will conclusively presume
that any date will be acceptable to you, and schedule the arbitration accordingly, I will attempt to
schedule the arbitration for the earliest date available to all arbitrators and counsel involved,
I would also appreciate it if counsel for the parties would note on the calendars that they
return to me the approximate amount of time that they believe that their case will take to present,
and the number of witnesses that they intend to call, in the spaces provided,

COMPLAINT
M & M Contractors, Inc., by and through their attorneys, Keith A. Noll, Esquire,
and Maxwell Law Offices, states the following in support of its Complaint:
1. Plaintiff is M & M Contractors, Inc., a corporation duly incorporated under
the laws of the Commonwealth of Pennsylvania, with a principal office at 221 West
Martin Avenue, Shippensburg, PA 17257.
2. Defendant is Oakwood Homes, Inc., a corporation organized under the
laws of the Commonwealth of Pennsylvania, with an address of 422 West Main Street,
Mountjoy, PA, 17552.
3. On or about April 6-7, 2000, Plaintiff conducted and completed excavation
and concrete work on behalf of, and as requested by, the Defendant in York and
Franklin counties (the "Bray and Matson jobs").
4. On numerous occasions, Plaintiff sent invoices totaling Two Thousand
Four Hundred Twenty Eight and 25/100 ($2,428.25) Dollars to the Defendant for its
services performed and materials used at the Bray and Matson jobs. See Exhibits "A-1"
and "A-2", attached and incorporated by reference.

5. All charges invoiced on the Bray and Matson jobs constitute the usual,

7. Defendant has failed to make payment on the invoices.
8. In April, 2000, Plaintiff conducted and completed work, on behalf of, and
as requested by, the Defendant in Shippensburg (the "Hays job").

Hundred Seven and 20/100 ($607.20) Dollars to the Defendant for its services
performed and materials used at the Hays job. See Exhibit "B", attached and

customary, and reasonable fees and/or charges for such services and/or materials.
11. All work performed by Plaintiff at the Hays job was done in a timely and
workmanlike manner.
12. Defendant has failed to make payment on the invoices.
13. In April, 2000, Plaintiff conducted and completed additional excavation
