Trostle ("Owner"). Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection of a single family dwelling upon a lot of land situate in South Middleton Township, Cumberland County, Pennsylvania, more fully described as follows: ALL THAT CERTAIN tract of unimproved land situate in South Middleton Township, Cumberland County, Pennsylvania, bounded and described according to a Final Subdivision Plan for Larry L. Warner and Jonietta Warner and Donald L. Brickner and Nellie Brickner prepared by Stephen G. Fisher, P.L.S., dated September 25, 2001, revised through December 11, 2001, and recorded May 6, 2002, in Cumberland County Plan Book 85, Page 54, as follows: BEGINNING at point in Whiskey Spring Road (T-550) at the northwest comer of lands now or formerly of John H. James; thence along the said Whiskey Spring Road, North 01 degree 36 minutes 41 seconds West 311.50 feet to an existing railroad spike; thence along said Whiskey Spring Road, North 11 degrees 52 minutes 39 seconds East 104.03 feet to a point; thence along Lot No. 2 as shown on the above referenced Plan, South 71 degrees 17 minutes 40 seconds East 67.09 feet to an iron pin set; thence along said Lot No. 2, South 78 degrees 54 minutes 55 seconds East 1033.01 feet to an iron pin set; thence along lands now or formerly of Donald L. Brickner and Nellie Brickner, South 38 degrees 30 minutes 06 seconds West 857.42 feet to an iron pin set; thence along lands now or formerly of John H. James, North 41 degrees 49 minutes 06 seconds West 718.88 feet to an existing axel in stones; thence along same, South 53 degrees 02 minutes 19 seconds West 96.15 feet to point, the point and Place of BEGINNING. CONTAINING 11.544 acres and being Lot Number 3 of the above referenced Subdivision Plan. Now, i, 9'4 at the time °fand immediatelybef°re the executi°n of the c~'~uCfion contract aforesaid, and before any authority has been given bythe said Steven R. Trostle to the said Contractor/Subcontractor to commence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
