STIPULATION AGAINST LIENS
THIS AGREEMENT made the 119-+h
and between KEELEY AND COMPANY,
of uc-k>bt.e.. ,2000, by
AND
WILLIAM D. KEELEY AND KYM A. KEELEY, his wife, hereinafter
referred to as Owner, whereby the former undertook and agreed to
erect and construct a single family dwelling on that certain lot
of ground situate as set forth in attached legal description,
known as: Lot 92, of the Final Development Plan, Final Plan "A"
(PRO), Village of Westover (East) which Fianl Development Plan is
recorded in the Office of the Recorder of Deeds of Cumberland
County in Plan Book 53, Page 130.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to Keeley and Company in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL THAT CERTAIN tract or parcel of land situate in the
Township of Hampden, County of Cumberland and Commonweath of
Pennsylvania, being more particulary bounded and described as
follows, to wit:
BEGINNING at a point on the Southern legal right-of-way line
of Stephen'S Crossing at the Northwest corner of Lot 91, on the
hereinafter described Final Development Plan; thence along the
western line of said Lot 91, South 35 degrees 13 minutes 51
seconds West a distance of 125.00 feet to a point at the Northern
line of land now or late of Noll Acres; thence along the Northern
line of said Noll Acres, North 54 degrees 46 minutes 09 seconds
West, a distance of 85.00 feet to a point at the Southeast corner
of Lot 93, on the hereinafter described Final Development Plan;
thence along the Eastern Line of Lot 93, North 35 degrees 13
minutes 51 seconds East, 125.00 feet to a point on the Southern
Legal right-of-way line of Stephen's Crossing; thence along the
Southern legal right-of-way line of Stephen's Crossing South 54
degrees 46 minute~ 09 seconds East a distance of 85.00 feet to a
point at the Northwest "corrier of Lot #91, on the hereinafter
described Final D~yelopment Plan, the point and place of BEGINNING.
CONTAINING 10;625 square,feet, more or less.
BEING LOT 92, 'of th~ FiD:al Development Plan, Final Plan "A"
(PRD) , Village of Westqver (East) which Final Development Plan is
recorded in the Of;fice -of the Recorder of Deeds of Cumberland
County in Plan B06l5: 53,. Page 130.
UNDER AND SUBJ~CT to any and all restrictive covenants,
conditions, restri~tions, rights-of-way, easements and agreements
of record, including, but not limited to, Final Development Plan,
Final plan "A" (PRD) , Final Plan "B" (PRD) Village of Westover
(East) dated February 18, 1986, last revised February 24, 1987
(Final Plan "B") recorded in the Office of the Recorder of Deeds
of Cumberland County in Plan Book 53, Page 130, specifically
including NOTE FOUR FINAL PLAN "B" (PRD and NOTE FIVE FINAL PLAN
"A" (PRP) (Sheet 3 of 3) thereof; Final Site Development Plan of
Village West (East) Phase I, dated November 15, 1986, recorded in
the Office of the, Recorder of Deeds of Cumberland County in Pland
Book 53, Page 14],,', together with Final Revised Development Plan
for the Village of'Westover (East Sction) Phase V and VI, dated
March 1989, recorded in the Office of the Recorder of Deeds of
Cumberland County.in Plan Book 60, Page 74.
