Dear Andy,
Re: Concrete Cracking
Having work with concrete I'm sure.you realize how hard it is to guarantee a crack
free job. Proper joint placement and cutting of the joint is the most acceptable way to
control the characteristics of the chemical reactions that fake place in the hardening
of the matrix of the concrete. The joint will form a weaken plan and allow the built up
stress to produce a crack in the joint.
I have seen jobs that the best laid joint plans have failed in producing this result.
That's one of the reasons that proper curing, fiber reinforcing and admixtures to
control slump have been developed. They deal with stress and water amounts in
concrete. Most of these add to the cost ofthe finished project and are eliminated by
the project owner to save money.
I'm not aware of to many contractors that guarantee there concrete jobs will not
crack. Those that do have a action plan that they will come back to seal the crack or
if possible repair the crack with patching materials available.

COMPLAINT
TO THE HONORABLE, JUDGES OF SAID COURT:
AND NOW COMES, the Plaintiff, Natalie Fuchs, by and through her legal counsel, Henry F.
Coyne, and files the within Complaint and avers the following in support thereof:
1. Plaintiff is Natalie Fuchs, an adult individual who resides at 40 Foxcroft Drive,
Hampden Township, Cumberland County, Pennsylvania.
2. Defendant, is Andrew Snell, an adult individual who trades and does business under the
name of Andrew Snell Concrete Construction with its principal place of business at 30 Umberto (rear),

New Cumberland, York County, Pennsylvania.
3. On or about April 23, 1999, Plaintiff entered into a contract for Defendant to remove a
driveway and walk at Plaintiffs residence and to replace same with concrete. A true copy of the
complaint is attached as Exhibit "A".
4. On or about August 19, 1999, Defendant removed the concrete walk and driveway and
replaced them with concrete and concluded work on the contract on or about September 22, 1999 and
was paid for said work.
5. On or about February 13, 2000, Plaintiff noticed numerous cracks in the replaced
driveway and sidewalk.

6. Plaintiff alleges that Defendant's work and services was defective and unworkmanlike
and resulted in a breach of warranty, breach of contract and is in violation of the Pennsylvania Unfair
Trade Practices and Consumer Protection Law which is incorporated herein by reference.
7. Plaintiff will have to incur at $7,500.00 to remove the defective driveway and sidewalk
poured and installed by Defendant and to have the concrete work replaced and installed correctly. A true
copy of estimate of corrective work is attached hereto as Exhibit "Boo.
WHEREFORE, Plaintiff prays this Honorable Court to find in favor of Plaintiff and
against Defendant and to award Plaintiff damages in the amount of $7,100.00, plus counsel fees, court
costs, and interest and all other such damages which this Court deems appropriate pursuant to 73 P .S.
201-8 et se. the Pennsylvania Unfair Trade Practice and Consumer Protection Law.

STEPHEN M. YINGST. P.E.
Areas of Expertise
Mr. Y'mgst is a graduate engineer and Registered Professional Engineer in the State
of Pennsylvania. He has also completed all of the course requirements far a Master in
Engineering degree from Pennsylvania State University, needing only the completion of his
thesis for graduation.
As President of Criteriznn-Yingst Engineers, he is responsible for the development
and management of the firm. He is also actively involved in serving client needs for
building and property evaluations, investigative engineering, builder quality audits,
environmental assessments and design assistance.
Steve has completed over 3000 residential and commercial property evaluations, a
building quality audit for a residential contractor of more than 100 homes per year,
numerous structural damage insurance investigations, and various Phase I brviromnental
Assessments for Mellon Bank, Pennsylvania National Bank, Dauphin Deposit, the
Resolution Trust Corporation and others. In addition, Steve has testified as an expert
witness in numerous litigation matters in Allegheny, Cumberland, Dauphin, Lebanon and
Jtmiata counties.
Qualifications
Steve has attended initial and yearly continuing education programs with Criterium
Engineers, a national firm which franchises building evaluation services. Steve currently
operates two franchises in central and western Pennsylvania
Before establishing his ownfinn in 1990, Steve held several design and management
positions with AMP, Incorporated, the world's largest electrical interconnection device .
manufacturer. His last position there was as Project Manager aver the development of
various electro-mechanical devices. In this position, he directed and reviewed both
mechanical and electrical engineering disciplines and peiformed general project
management responsibilities.
Steve has also been involved with various phases if residential and light commercial
construction over the past fifieen years. This experience has included residential home
construction, major remodeling projects and electrical contract work with area building
firms.

INTRODUCTION
At your request, an inspection of the above property was performed on October 26, 2000. The
report that follows has been prepared based on that inspection. The purpose of the inspection and
this report' was to evaluate the concrete driveway and walkways at the above residence.
This inspection was performed by and report written by Stephen M. Yingst, P .E.
As you requested, this evaluation is limited in scope, focusing on the concrete driveway and
walkway only. This inspection report is limited to observations made from visuiU evidence. No
destructive or invasive testing was performed.

This inspection and report have been conducted in compliance with the standards of practice of the
National Academy of Building Inspection Engineers.
DESCRIPTION
This home is a single-family residence with an attached garage at the left side. The focus of the
inspection was the concrete driveway measuring approximately 16 feet wide x 48 feet long off the
front of the garage, a concrete sidewalk at the left side of the garage and a stamped concrete
sidewalk between the driveway and front porch.
You reported that a previous concrete driveway was removed and replaced during the summer of
1999 . You further reported that the concrete for the new driveway was poured on August 19, 1999.
You provided a copy of the original proposal from Andrew Snell Concrete Construction dated April
20, I 99?, regarding repair work. You indicated that this was the contractor that removed the
existing driveway and installed the new driveway. The proposal also indicated that the concrete
sidewalk. to the left garage door and continuing to the left rear of the home, would be removed and
replaced. The proposal further indicated that a curved walk. from the front porch to the driveway
would be installed.
You also provided a more recent quote from A-I Concrete Leveling ofCentra1 PA, Inc. dated July
12, 2000. This proposal was to remove the new concrete driveway and replace it.
Finally you provided copies of excerpts from The (Harrisburg) Patriot News newspaper from
Thursday August 19 to Sunday August 22, 1999 regarding weather conditions during that period.
For purposes of this report, all directions (left, right, rear, etc.) are taken from the viewpoint of an
observer standing in front of the building and facing it.

INSPEcnON FINDINGS
During my site inspection on October 26, 2000, you indicated that you noticed surface hairline
cracks in the driveway during the first month after pouring. You also reported that you first

noticed larger cracks in two of the slabs in February of 2000. You atso reported that the
driveway was not used for vehicular traffic for at least five weeks after pouring as your personal
car was stored at the neighbor's home across the street.
You reported that the concrete was not covered or otherwise protected the day it was placed.
You did recall that an unidentified sealer C'Kure & Seal compound" was specified in the Andrew
Snell proposal) was applied to the surface of the driveway approximately 24 hours after the
concrete was placed.
A review of weather conditions from The Patriot News newspaper articles reveals the following:

During my site visit, the concrete surfaces were visually inspected. Six small test pits were also
dug along the driveway as shown on the attached sketqh. These pits were dug to the bottom of
the stone base below the driveway.
The following deficiencies were noted in the concrete finish and with respect to the Andrew
Snell Concrete Construction proposal of April 20, 1999 (the proposal):
. The thickness of the concrete and stone base observed in the test pit areas was inadequate.
The following table summarizes the thickness of the stone and concrete in the six test pit
areas. Based on the proposal, the stone thickness should have been at least four inches thick
with a minimum of four inches of concrete. Photographs 1, 2, 3, 4, and 5 show
mea~ements of the slab and stone in test pits 1 through 5 respectively.

. The stone base was specified to be 2Bstone in the proposal. This size of stone (2B) i~
nonnally used under concrete slabs because it is a fairly clean stone (little dirt or dust/fine
stone mixed in) and is nominally 3/4" in size to allow drainage below the slab. Based on
samples pulled from under the concrete slab, 2A modified stone was instaIIed by the
contractor. The 2A stone varies in size from dust to approximately 1/2" and may have some
soil mixed in. The 2A modified stone is normaIly used where compaction of the material is
desired and it does not provide good drainage.

"" Improper expansion joint material was used between the concrete slabs. As photograph 6
shows, the expansion material has deteriorated and is falling apart. Following my site visit, I
reviewed information from the W. R. Meadows Co., who supplies this type of expansion
joint material. The material used on this job is a fiberboard material that is not normally
recommended for exterior use unless the expansion joint material is recessed 1/2" below the
concrete surface and a joint sealant is installed over the expansion joint to prevent water
entry and deterioration. The existing fiberboard joints were not recessed and sealed and has
deteriorated badly as a result.
. A large crack has appeared in the right side concrete slab adjacent to the front street. This
can be seen in photograph 7. The crack is approximately 1/8 inch in width with several areas
that have opened up from 1/4 inch to 1/2 inch and where concrete along the crack edge has
broken loose. This crack continues into the adjacent sllib to the rear as can be seen in the
photograph.
. Photograph 8 shows hairline cracks throughout the concrete surface. This photograph was
taken in the third slab toward the street from the garage on the right side. These cracks are
"plastic shrinkage cracks" which are caused by the rapid loss of water from the surface of the
concrete as it dries before the concrete has properly set.
. A gray and white striped appearance has occurred primarily on three of the concrete slabs at
the right side of the driveway. This can be seen in photograph 9. A close-up of this can be
seen in photograph 10.
. Photograph 11 shows a random crack through the first and second slab in front of the garage
on the left side. This crack is approximately 1/8 inch in width with areas where double
cracks have developed, and pieces of concrete up to 3/4 inch wide are ready to break from
the surface or have already broken out. The crack extends completely through the slab. The
crack almost parallels the main front to rear expansion joint, which was installed in the slab.
It is my opinion that this crack is the result of settlement due to inadequate sub-base material.
. The curved, stamped, concrete sidewalk from the driveway to the front porch is shown in
photograph 12. The close-up of this walkway shows that the saw-cut control joints placed in
the stamped concrete were not properly sealed as specified in the proposal. Based on the
Snell proposal, the joints should have been sealed with Sika Flex sealant.
. At the left front corner of the garage, the sidewalk makes a 900 turn to the rear as shown in
photograph 14. The close-up of the inside comer of this sidewalk shows that a crack has
developed at the inside comer. In addition, the control joint has cracked through in the
remaining portion of the joint. This area should have had an expansion joint to allow the two
sidewalk sections to move independently. Without the expansion joint, cracking of the
surface at the inside corner has occurred as was to be expected.

CONCLUSIONS
Based on the visible evidence available, it is my opinion that the concrete driveway slab at the
front of the home is in poor condition and below normal workmanship standards. This is the
result of improper installation. In addition the work does not meet the specifications outlined in
the April 20, 1999 proposal from Andrew Snell Concrete Construction. Specific deficiencies
include: .
· Improper use of expansion joint material which has deteriorated and should be replaced.
. Inadequate stone sub-base material (less than four inches thick).
. Use of different (improper) stone material for sub-base (2A stone was used in place of 2B
stone as specified).
· Inadequate concrete thickness in some areas including test pits 5 and 6 (less than four
inches).
. Unsealed control joints which were cut into the concrete walk.
Furthermore, it is my opinion that the plastic shrinkage cracks in the surface of the concrete are
the result of improper curing conditions due to the high temperatures at the time of the pour, and
the lack of proper protection of the concrete surface. Specifically, the concrete surface cured too
quickly without allowing the main portion of the concrete to set and bleed water to escape in a
normal curing process. As a result the amount of cracks in the driveway slabs are more than
normal and the construction quality is below typical workmanship standards.
In addition, it is my opinion that the cracks that penetrate the entire slab thickness are the result
of inadequate sub-base material and resulting settlement.
Finally, the crack in the sidewalk surface at the left front of the garage is the result of a missing
expansion joint in this area.
To properly correct these conditions, the entire concrete driveway slab and a portion of the left
side sidewalk should be removed, proper stone sub-base installed, and new concrete placed.
You also requested that I review the proposal provided by A-I Concrete Leveling of Central PA.,
Inc. to do the repair work. This proposal is generally in line with the work I would recommend.
Key improvements over the Snell contract are:
. Six inches of2B stone sub-base.
--. The use of wire reinforcing mesh in this concrete.
. Asphalt expansion joints instead of fiber joints.
. Five inches of concrete.
. 4,000 psi concrete versus 3,500 psi in the original proposal.
Most of the A-I Concrete Leveling of Central PA., Inc. propOsal indicates that all of the
driveway will be replaced. However, there is an.asterisked item on page one which indicates that
only five sections of the driveway (the cracked sections only) will be replaced. This should be
clarified prior to performing the work. I recommend that all of the driveway be removed so that
