On or about October 7, 1998 Defendants made a partial payment on debt in the amount of$I,OOO.OO. 9. Despite repeated requests and demands defendants have failed and refused to pay to Plaintiff the remaining debt due under the contract. Plaintiff is Penn Insulation & Home Improvement Co., a Pennsylvania corporation, with a place of business 711 Olive Street, York, Pennsylvania 17403. 2. Defendants are William Alward and Cindy Alward, his wife, residing at 1103 Granada Lane, Mechanicsburg, Pennsylvania 17055. 3. On March 25, 1995 Defendants entered into a written agreement whereby Plaintiff was to install replacement windows and do other work at Defendants' home at 1103 Granada Lane, Mechanicsburg, Pennsylvania for a contract price of $8,400.00. Defendants were unhappy with the french door provided by the Plaintiff, and since it was not used, Plaintiff gave Defendants a credit of $1 ,500.00 on the contract. 5. All other work was performed by Plaintiff in a workmanlike manner and was accepted by Defendants. 6. All work was completed on the contract on or before May 24, 1995. 7. Despite repeated requests and demands Plaintiff has only paid $1,000.00 on the balance of the contract. 8. Under the terms of the contract Plaintiff is entitled reasonable counsel fees in pursuing this collection action in the amount of 20% and interest on the unpaid balance in the amount of 1.5% per month. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $5,900.00, interest at the rate of 1.5% per month beginning 30 days from the completion date of May 24, 1995, and attorney's fees of20% of the unpaid balance. Despite repeated requests and demands Plaintiff has only paid $1,000.00 on the balance of the contract. 8. Under the terms of the contract Plaintiff is entitled reasonable counsel fees in pursuing this collection action in the amount of 20% and interest on the unpaid balance in the amount of 1.5% per month. On March 25, 1995 Defendants entered into a written agreement whereby Plaintiff was to install replacement windows and do other work at Defendants' home at 1103 Granada Lane, Mechanicsburg, Pennsylvania for a contract price of $8,400.00. A copy of the contract is attached hereto as Exhibit COUNT I 4. The averments of paragraphs 1 through 3 hereof are incorporated herein by reference thereto. 5. Defendants were unhappy with the french door provided by the Plaintiff, and since it was not used, Plaintiff gave Defendants a credit of $1,500.00 on the contract. 6. All other work was performed by Plaintiff in a workmanlike manner and was accepted by Defendants. 7. All work was completed on the contract on or before May 24, 1995. 8. On or about October 7, 1998 Defendants made a partial payment on debt in the amount of $1,000.00. 9. Despite repeated requests and demands defendants have failed and refused to pay to Plaintiff the remaining debt due under the contract. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $5,900.00, plus cost of suit, which sum does not exceed the amount requiring referral to arbitration under Local Rule. COUNT II 10. The averments of paragraphs 1 through 9 hereof are incorporated herein by reference thereto. 11. Under the terms of the contract Plaintiff is entitled reasonable counsel fees in pursuing this action to collect the debt.
