JESSICA HUDSON, Defendant. ANSWER AND COUTERCLAIM Defendant, Jessica Hudson ("Hudson"), for her Answer to the Complaint filed by the plaintiff Noah Weisberg ("Weisberg"), states as follows: 1. Hudson admits the allegations contained in paragraph 1 of the Complaint. 2. Hudson admits the allegations contained in paragraph 2 of the Complaint. 3. Hudson admits the allegations contained in paragraph 3 of the Complaint. 4. Hudson admits the allegations contaihed in paragraph 4 of the Complaint. 5. Affirmative Defenses Having answered all of the allegations contained in Weisberg's Complaint, Hudson submits the following affirmative defenses: 1. Hudson is not indebted to Weisberg in any amount whatsoever. 2. The vehicle was rejected pursuant to 13 Pa.C.S. 92608 based on the discovery of a defect, namely, that the transmission had not beenproperIy bolted to the engine when it was replaced by Plaintifflast year. ~ _' ~ ,I- ~~__L _ ~ ,.-", ," \ 3. Acceptance of the vehicle was properly revoked pursuant to 13 Pa.C.S. 92608 based on the defect that was unknown at the time of sale and the difficult to discover before acceptance was made. 4. In the alternative, if Hudson is found liable to Weisberg in any amount, whatsoever, for the reasons set forth in the counterclaim stated below, Hudson is entitled to set-off, in an amount to be determined by the evidence at trial, but not less than $300.00. WHEREFORE, Jessica Hudson respectfully requests that the Complaint be dismissed; that judgment be granted in favor of Hudson, and that the Court grant Hudson such other and further relief as it deems appropriate. Counterclaim Hudson for her Counterclaim against Weisberg states as follows: I. On July 22, 2000, after Defendant drove the vehicle for approximately twenty minutes, it stopped running. 2. On July 22, 2000, Defendant had the vehicle towed to Sam and Jerry's, a mechanic shop. 3. The vehicle was examined by Michael James, an automobile technician, who determined that the transmission had not been properly bolted to the engine when it was replaced by Plaintiff last year causing the engine to rock. The mechanic further determined that the defect in the vehicle was difficult to discover. 4. On or about July 22, 2000, Defendant delivered a check in the amount of $300.00 to Plaintiff and agreed to pay the remaining amount when Defendant received her loan money sometime in August, 2000. 5. On or about July 22, 2000, Plaintiff transferred the vehicle and the vehicle's title to Defendant. 6. In or about July, 2000, due to Defendant's admitted inability to drive said vehicle properly, Defendant negligently did substantial and material damage to said vehicle. 7.
