COMPLAINT IN ACTION OF MORTGAGE FORECLOSURE The Plaintiff, PNC Bank, National Association, by its attorneys, KREDER, BROOKS, HAILSTONE & LUDWIG, brings this action against the Defendants and, in support of its claim, avers the following facts: 1. PNC Bank, National Association, is a national banking association with an office at 2730 Liberty Avenue, Pittsburgh, PA 15222 (the "Plaintiff"). 2. Sae Y oul Calmg, alk/a Harry J. Calmg, and Hee Ja Calmg, alk/a Lena 1. Calmg, his wife, (the "Defendants") are adult individuals whose last known mailing address is 3 Patton Road, Mechanicsburg, Pennsylvania 17055. 3. The property address is 3 Patton Road, Mechanicsburg, Cumberland County, Pennsylvania 17055. __to ~I -" ~--, :"-'" 4. In consideration for a promissory note in the original principal amount of EIGHTY- THREE THOUSAND SEVENTY-FIVE DOLLARS AND 00/100 CENTS ($83,075.00) made by the Plaintiff, the Defendants executed and delivered to the Plaintiff their Note dated March 5 1999 , , obligating them to pay to the Plaintiff the sum of $83,075.00, with interest, in contracted monthly installments of SEVEN HUNDRED SEVENTY-ONE DOLLARS AND 38/1 00 CENTS ($771.3 8) per month, to be applied to interest at the rate of 7.49% per annum, and the balance to be paid on principal as more fully set forth in the Note, a copy of which is attached hereto as Exhibit" A" and incorporated herein by reference (the "Note"). 5. The Note is secured by a Mortgage from the Defendants in favor of the Plaintiff dated March 5, 1999 and recorded in Cumberland County Mortgage Book 1527 at page 963, a copy of which is attached as Exhibit "B" and incorporated herein by reference (the "Mortgage"). 6. The Mortgage has not been assigned. 7. The land subject to the said Mortgage is more particularly described in Exhibit "e" attached hereto and incorporated herein by reference (the "Premises"). 8. The Defendants are the real owners of the Premises. 9. The specific default ofthe Defendants is as follows: no payment has been made on the obligation created by the aforesaid Note and Mortgage since September 15, 1999. 10. The requisite Notice under the Emergency Assistance Act of 1983 Housing Bill No. 500, Act 91, as well as timely Notice of Intention to Foreclose pursuant to Section 403, Act No.6 of1974, Pa. 41 C.S.A. Section 403, was sent by the Plaintiff to the Defendant at the address of the Premises and also to his last-known addresses on April 26, 2000 in accordance with the provisions ~ ~ ", .~, ,,~ - , ofthe those Acts. Copies of the letters are attached as Exhibit "D" and incorporated herein by reference. 11. The amount due by the Defendants to the Plaintiff as of June 23, 2000, consisting of principal, accumulated interest, late charges, taxes, advanced insurance premiums and other escrow charges, is EIGHTY-SIX THOUSAND SEVEN HUNDRED EIGHTY-SIX DOLLARS AND 87/100 CENTS ($86,786.87), together with additional interest from June 23, 2000 and attorneys' fees in an amount not less than $850.00, and costs. 12. A Validation Notice pursuant to the Fair Debt Collection Practices Act is attached hereto as Exhibit "E" and incorporated herein by reference. WHEREFORE, judgment in mortgage foreclosure and judicial sale is hereby demanded in favor of the Plaintiff, PNC Bank, National Association, and againsttheDefendants, Sae Youl Cahng, alk/a Harry J.
