STIPULATION AGAINST LIENS
THIS AGREEMENT made
between W G Tomlco& Sons
this 11th day of October , 2000, by and
hereinafter referred to as Contractor,
AND
Cumberland County, herein",fter referred to as Owner, whereby the
Contractor undertook and"""agreed to construct an addition and
improvements on the certain lot of ground situate in Middlesex
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fUlly described in Exhibit "A" which is attached hereto and made a
part hereof known as Claremont Nursing & Rehabilitation Center, 375
Claremont Drive, Carlisle, PA.

NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the sa~a
Contractor, for an in conlSideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
ack."'J.owledg~d, and the further consideration mentioned in the
agreement acforesaid, for ~tself, himself or themselves and its, his
or their subcontractors , and all parties acting through or under
them, co'lien:'a1j.,t:aIJ,o. agree that no mechanic's liens or claims shall
be~;i,led:Qr,ro:.aiiit~'ained by them or any of them against the said
bui'ld'ingsaatl'''the' 'J;'qt of ground appurtenant thereto for or on
acCotlIit!',6t' any" work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor i for itself, himself or
tha~selves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Cumberland, bounded and describes as follows:
BEING part of the premises which Edward 1. Stiles and Ann Stiles, husband and wife, by Deed
dated December 24, 1829, which Deed is recorded in the Office of the Recorder of Deeds in and
for Cumberland County in Deed Book MN-l, page 305, granted and conveyed to the The
Directors of the Poor and ofthe House of Employment of Cumberland County and being part of
the premises which William Homes Estate, by Administrator, by Deed dated November 27,
1938, which Deed is recorded in the Office of the Recorder of Deeds in and for Cumberland
County in Deed Book RR-l, page 1368, granted and conveyed to The Directors ofthe Poor and
the House of Employment of Cumberland County.
Less the area ofland which Cumberland County, by Deed dated August 23, 1999, wliich Deed is
recorded in the Office of the Recorder of Deeds in and for The United States of America in Deed
Book Vol. 206, page 273. CONTAINING an area of55.7l83 acres.
This area of land as referenced above is known as Claremont Nursing and Rehabilitation Center
of Cumberland County.
