WHEREAS, Dr. Herbert I Soller and Carol R. Soller, his wife, Owners, of Camp Hill,
Cumberland County, Pennsylvania, are about to execute contemporaneously herewith, a
contract, with Carlson Construction of Camp Hill, Cumberland County, Pennsylvania, for the
following services: construction of a two story brick modified ranch dwelling with exposed
basement on Lot K-9 at 7 Saratoga Place, Floribunda Heights, East Pennsboro Township,
Cumberland County, Pennsylvania:
ALL THAT CERTAIN lot ofland situate in the Township of East Pennsboro, County of
Cumberland, and Commonwealth of Pennsylvania, bounded and described as follows, in
accordance with the Final Subdivision Plan for Floribunda Heights, Phase II, Sections K & H,
dated October 5,1999, prepared by Melham Associates, P.C., and recorded in Plan Book 80,
Page 45, and revised on February 17, 2000, and recorded in Plan Book 80, Page 104, to wit:
BEGINNING at a point on the northern side of Saratoga Place at the southwestern corner of Lot
No. K-10 on the above mentioned Plan of Lots; thence along the western line of Lot No. K-IO,
North 10 degrees 17 minutes 25 seconds West 145.84 feet to a point at the lands now or formerly
ofFloribundaAssociates; thence along the said same lands, South 71 degrees 15 minutes 00
seconds West, 122.75 feet to a point at the northeastern corner of Lot No. K-8 on the above
mentioned Plan of Lots; thence along the eastern side of Lot No. K-8, South 21 degrees 51
minutes 54 seconds East, 140.09 feet to a point on the northern side of Saratoga Place; thence
along the northern side of Saratoga Place, by a curve to the right having a radius of 465.00 feet
and an arc length of93.94 feet to a point, the point and place of BEGINNING.
CONTAINING 15,239.974 square feet.
BEING Lot No. K-9, on the above mentioned Plan of Lots.

, 2000, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Owners
to the said Contractor to commence the said work, or purchase materials for the same in
consideration of the making of the said contract with Contractor, and the further consideration
of One Dollar, to Contractor paid by Owners, it is agreed that no lien shall be filed against the
property by the Contractor, or any sub-contractor, nor by any of the material men or workmen
or any other person for any labor, or materials purchased, or extra labor or materials purchased
in connection with said work, the right to file such liens being expressly waived.
