COMPLAINT
1. Plaintiff, Union Quarries Inc. is a Pennsylvania corporation maintaining
an office and place of business located in Carlisle, Cumberland County,
Pennsylvania.
2. Defendant, Timothy L. Martin is an adult individual and trades and
conducts business under the name of Tim Martin Paving, who maintains a residence
and/or place of business located at 5051 Wayne Road, Chambersburg,
Pennsylvania 17201.
3. Defendant, Mary E. Martin is an adult individual who trades and
conducts business under the name of Tim Martin Paving, who maintains a residence
and/or place of business located at 5051 Wayne Road, Chambersburg,
Pennsylvania 17201.

4. At the special instance and request of the Defendants, Plaintiff sold and
tendered to Defendants various building materials and supplies for which there is
presently due and owing to Plaintiff by Defendants the sum of $56,456.20.
5. Plaintiff has rendered to Defendants Statements of Account showing a
balance due to Plaintiff by Defendants in the amount of $56,456.20, to which the
Defendants have not objected and an account has therefore been stated between
Plaintiff and Defendants as set forth in Exhibit "A", which is attached hereto and
incorporated herein, in the amount certain of $56,456.20.
6. Although duly demanded the said account balance in the amount of
$56,456.20 has not been paid by Defendants to Plaintiff or to anyone acting on
behalf of Plaintiff and is therefore due and payable with interest at the rate of 18%
per annum.
WHEREFORE, Plaintiff demands Judgment against the Defendants in the
amount of $56,456.20 plus interest at the rate of 18% per annum and the cost of
suit.
