THE FOLLOWING NOTICE IS BEING PROVIDED TO EACH AND EVERY INDIVIDUAL OR ENTITY NAMED
AS A DEFENDANT IN THIS COMPLAINT PURSUANT TO THE PROVISIONS OF THE FAIR DEBT
COLLECTION PRACTICES ACT - 15 U.S.C. Section 1601, et seq.
THE UNDERSIGNED ATTORNEY IS A DEBT COLLECTOR AND THIS COMPLAINT IS AN ATTEMPT TO
COLLECT A DEBT OWED TO THE PLAINTIFF(S), AND ANY INFORMATION RECEIVED WILL BE

COMPLAINT
1. The Plaintiff, Lawrence M. Roche, is an adult individual, who
resides at 107 Maple Hill Rd., Blossburg, PA 16912.
2. The Defendant, Donald L. Gingrich, is an adult individual, who
resides at 501 Mohn St., Apt. 506, P. O. Box 7590, Steelton, PA 17113.
3. The Defendant is the surviving spouse of Edna P. Gingrich, an adult
individual, who died on November 24, 2002.
4. The Plaintiff is the owner of record of a certain parcel of real
property situate at 407 N. Front St., West Fairview, Enola, Cumberland
County, PA , more particularly described in a Deed recorded in the
Cumberland County Recorder of Deeds Office on July 24, 1990 in Book 34,
Vol R, page 703, which vested title in Plaintiff, a copy of which is
attached hereto as Exhibit "A "and made a part hereof.
5. On or about November 21, 1994, Plaintiff and Donald L. and Edna P.
Gingrich, his wife, entered into an installment Agreement of Sale for the
sale and purchase of the said real property, which Agreement of Sale was
recorded in the Cumberland County Recorder of Deeds Office in Book 486,
page 595, a copy of which is attached hereto as Exhibit "B "and made
a part hereof.
6. Pursuant to the provisions of the said Agreement of Sale, the
Gingrichs were in possession and control of said real property, and
occupied same from on or about November 21, 1994 until on or about
October 14, 2002, at which time they voluntarily and intentionally
abandoned occupancy, possession and control of the said real property;
removed all their personal property from the property and ceased doing
maintenance and repairs to the property.
7. On or about October 14, 2002, the Defendant, Donald L. Gingrich,
voluntarily abandoned custody, possession and control of the real
property to the Plaintiff by handing Plaintiff the keys to the premises
and informing Plaintiff that Gingrichs had no intention of returning
to the premises; and since that time have not returned to the real
property nor made any attempt to reoccupy or repossess said premises.
8. The Gingrichs are in default of the terms and conditions of the
said Agreement of Sale by failing to make the regular monthly install-
ment payments due and owing for November 2002 and each successive month
thereafter.
9. The Agreement of Sale provides that a breach by the Gingrichs of
the terms and conditions renders the Agreement null and void at the
option of the Plaintiff and constitutes a forfeit by the Gingrichs of
monies paid as liquidated damages, representing the fair rental value
for the period of occupancy of the property.
10. The failure of the Gingrichs to make the regular monthly install-
ment payments and to maintain and repair the real property constitute
breaches of the Agreement of Sale.
11. By virtue of the Gingrich's breaches of the Agreement of Sale and
their abandonment of the said real property, the said Agreement of Sale
is null and void, and the Gingrichs have abandoned, rescinded, and
forfeited any right, title or interest in and to the said real property.
12. Any right, title or interest in and to said real property which the
Gingrichs may have had pursuant to the said Agreement of Sale or other-
wise vested solely in the defendant, Donald L. Gingrich, as surviving
tenant by the entireties by operation of law upon the death of his wife,
Edna P. Gingrich.
13. The recorded Agreement of Sale is, and continues to be, a cloud on
the Plaintiff's title to the said real property.
WHEREFORE, the Plaintiff prays this Honorable Court for an Order
declaring that the Defendant, Donald L. Gingrich, his heirs, successors
and assigns are forever barred from asserting any right, title, lien,
claim and/or interest in the Plaintiff's real property situate at
407 N. Front St., W. Fairview, Enola, Cumberland County, Pennsylvania;
and authorizing and directing the Cumberland County Recorder of Deeds to
cancel the Agreement of Sale between the Plaintiff and the Donald L. and
Edna P. Gingrich recorded in Book 486, page 595, and to so mark the record.
