JASON L. KECK, Plaintiff · Defendant · COMPLAINT ACTION IN REPLEVIN 1. PlaintiffBSB Bank & Trust is a New York State chartered bank having a place of business at 58-68 Exchange Street, Binghampton, New York, 13902. 2. Defendant, Jason L.Keck is an adult individual with a last known address of 10 Mt. View Terrace, Newville, Cumberland County, Pennsylvania 17241. 3. On or about August 1, 2000, Defendant entered into a Note, Disclosure and Security Agreement with Forward Financial Company of 360 Church Street, Northboro, Massachusetts 01532 for the purchase money financing of a used 1982 Redman 52' x 24' Mobile Home, serial number 12212141 (the "Mobile Home.") A tree and correct copy of the Note and Security Agreement is attached hereto as Exhibit "A" and incorporated herein by reference as if fully set forth. 4. By Assignment dated August 1, 2000, Forward Financial Company assigned all of its rights, benefits, title and interest in the Note and Security Agreement to Plaintiff. A true and correct copy of the Assignment is attached hereto as Exhibit "B" and incorporated herein by reference as if fully set forth. l155240_l.doe 5. Plaintiff's perfected security interest in the Mobile Home is evidenced by a Commonwealth of Pennsylvania Certificate of Title, a tree and correct copy of which is attached hereto as Exhibit "C" and incorporated herein by reference as if fully set forth. 6. Defendant defaulted under the Note and Security Agreement by failing to make monthly payments when due beginning December 5, 2002 and on the fifth (5th) day of each month thereafter. 7. Pursuant to the Note and Security Agreement, in the event of default, Plaintiff may, and by letter dated February 3, 2003 did, make unpaid principal, earned interest and other agreed charges owed by Defendant under the Note and Security Agreement immediately due. A tree and correct copy of Plaintiff's February 3, 2003 letter is attached hereto as Exhibit "D" and incorporated herein by reference as if fully set forth. 8. Pursuant to the Note and Security Agreement, Plaintiff gave Defendant notice of Plaintiff's intention to repossess the Mobile Home and an opportunity to cure Defendant's default. See Exhibit "D." 9. As a result of Defendant's default under the Note and Security Agreement, Plaintiff is entitled to immediate possession of the Mobile Home. The present fair market wholesale value of the Mobile Home is approximately 10. $6242.OO. 11. Defendant, Jason L. Keck, has possession of the Mobile Home at 10 Mt. View Terrace, Newville, Pennsylvania 17241. 1155240_1 .DOC WHEREFORE, PlaintiffBSB Bank & Trust demands judgment in replevin against Defendant Jason L. Keck for possession of the Mobile Home, plus costs, special damages thereon in the amount to be determined, attorneys' fees, and such other relief as this Court deems just.
