COMPLAINT
AND NOW, comes Plaintiff, Frey Hoffer Joint Venture
Partnership, by and through its attorneys, Law Offices Stephen C.
Nudel, PC, and respectfully files this Complaint as follows:
1. Plaintiff, Frey Hoffer Joint Venture Partnership, is a
Pennsylvania general partnership, with a business address of 14
Fuhrman Road, Marietta, Lancaster County, Pennsylvania 17547.
2. Defendants, Daryl K. Dissinger and Melissa Dissinger,
husband and wife, are adult individuals, individually and
sometimes tradin~ and doing business as Double D Farms, with an
/D2.2- f( Ells-l L,.,bu.rrI RoM
address of -443 McCennie], ~eaQI Mechanicsburg, Cumberland County,
Pennsylvania 17055.
3. Defendants operate a business located at 313 Coffee
Goss Road, Marietta, Pennsylvania 17547.
4. On or about April 2000, Defendants executed a Note
("Note") in favor of Plaintiff in the amount of $54,000.00
together with an interest rate of ten percent (10%-) per annum. A
true and correct copy of the Note is attached hereto and made a
part hereof as Exhibit A.

5. The Note was amortized for a period of 36 months with
installment payments of $1,742.43 payable monthly.
6. The first payment under the Note was due and payable
October 1, 2000, and the remaining payments due on the same day
of each month thereafter.
7. The Note provides, inter alia, that if payment has not
been received in the full amount by the end of seven (7) calendar
days after it is due, Defendant shall pay a late charge of five
percent (5%) of the past due amount.
8. The Note provides, inter alia, that Defendants' failure
to pay any part of the principal interest on the Note when due
authorizes Plaintiff to declare the entire amount of the Note due
and payable including all unpaid principal and interest due under
the Note.
9. The Note provides, inter alia, that in the event of
default by Defendants, Plaintiff may confess Judgment against
Defendants for the full amount due under the Note together with
costs and attorneys fees of 15% of the amount due.
10. The Note provides, inter alia, that Defendants shall
provide all financial information including but not limited to
operating statements, vendor invoices, payments to venders,
contracts with venders, contracts with clients/customers and
horse boarding agreements related to the operation of Defendants'
business.
11. Based upon the foregoing, Defendants are liable to
Plaintiff as follows:

WHEREFORE, Plaintiff demands Judgment against Defendant and
in favor of Plaintiff in the amount of $55,742.43 plus interest,
costs of suit and attorneys fees and requests an Order directing
Defendant provide all financial information including but not
limited to operating statements, vendor invoices, payments to
venders, contracts with venders, contracts with clients/customers
and horse boarding agreements related to the operation of
Defendants' business.
