COMES NOW, Plaintiffs, Stephanie and Scott Finkenbinder, by and through her attorney, James
J. Kayer, Esquire, who does hereby aver as follows:
1. Plaintiffs, Scott and Stephanie Finkenbinder, are adult individuals whose currently reside at
9 South Tolpehocken Street, Suite A, Pine Grove, Cumberland County, Pennsylvania 17963-1038.
2. Defendant, Virginia Adams, is an adult individual whose current residence is 917 W. Louther
Street, Carlisle, Cumberland County, Pennsylvania 17013.
3. On September 1, 1998, Plaintiffs and Defendant entered into a home lease contract whereby
the Plaintiffs leased premises located at 2 East Main Street, Plainfield, P A, from the Defendant. A copy of
the lease is attached hereto and incorporated herein and is designated as Exhibit "A".
4. The premise leased by Plaintiff's was one-half of a two-unit residence.
5. Over the course of residing at the residence, the Plaintiffs became aware of the fact that a foreign
electrical load existed on their electrical lines.
6. The Plaintiffs contacted the electrical provider, PP&L Utilities regarding the presence of a
foreign load. PP&L Utilities confirmed that a foreign existed and changed the billing of electrical service
from the Plaintiff s to the Defendant pursuant to existing statute.
7. When Plaintiffs contacted PP&L Utilities to determine what foreign loads were present on their
metered electrical service they were informed by PP&L that such information could only be provided to the
Defendant, as she was the only named individual on the electrical account.

8. Despite repeated requests by Plaintiffs to Defendant to correct the situation and for an accounting
of how much each party was to be responsible for in dividing the electrical bills, the Defendant did not
provide any evidence of the extent of the foreign load, the cost of electrical services associated with those
appliances and other equipment operating on the Plaintiff's lines and refused to provide any accounting other
than to demand payment of the entire electrical account.
9. The Plaintiffs received numerous notices from PP&L indicating that the Landlord was
failing to pay for electrical service in a timely fashion and that service was scheduled to be terminated for
this lack of payment.
10. The Plaintiffs made 3 (three) payments to PP&L on behalf of the Defendant, on October 2, 1998
they paid $324.60, on October 7,1998 $89.11 and on February 4,1999 a payment of $400.00.
11. In January 1999 the Defendant demanded that Plaintiffs should be responsible for payment of
all water bills. This demand runs counter to the lease provisions concerning the responsibility for water.
12. The Plaintiffs refused to agree to take on the expense for additional water charges.
13. The Defendant demanded that Plaintiff sign a note drafted by the Defendant that indicated that
it was to be Plaintiffs responsibility to purchase water.
14. The Plaintiffs were forced to pay a total of 8 water bills at $80.00 per load for water to be
trucked in and filled in their water tanle
15. The Plaintiff, Stephanie Finkenbinder signed the Landlord's note to signify that she had received
it but did not assent to it.
16. Pursuant to the terms of the lease, the Plaintiff's provided written notice on June I, 2000 of their
intention to vacate the premises.
17. The Plaintiffs did actually vacate the premises on June 30, 2000.
18.68 Pa. 9 250.512(a) requires a Landlord to retum a security deposit to a tenant within 30 (thirty)

days of taking possession ofthe premises or in the alternative to provide the tenant with a specified list of
deficiencies within the leased premises which caused the Landlord to withhold some or all of the security
deposit.
19. The Defendant failed to abide by the strict terms of the statute in that she did not forward her list
of deficiencies to the Plaintiffs until July 31, 2000, and the list was deficient in that it did not specify in
detail the specific damage and cost associated with damage to the leased premises.
20.68 Pa. S 250.512 (c) provides a remedy for tenants of Landlords who violate S 512 (a) of the act
whereby they may receive double their security deposit as damages for a Landlord's failure to comply.
21. The Plaintiffs initially filed a Civil Complaint with District Justice Shulenberger and as a result
ofthat filing, paid $67.00 in Court Costs.
22. The Plaintiffs claim as damages $1,060.00 representing the $530.00 security deposit doubled,
$640.00 for 8 (eight) water payments at $80.00 per load, $813.71 for electrical payments made on behalf
of the Defendant, $67.00 for costs incurred at the District Justice level and $45.25 for the filing of Plaintiffs
appeal and the complaint with the Cumberland County Prothonotary. These damages total $2,625.96.
WHEREFORE, the Plaintiffs demand judgement against the Defendant for a sum of $2,625.96.
This sum falls below the $25,000.00 jurisdictional amount.

Defendant denies that Plaintiffs were responsible for the entire load of water

was determined that such load represented approximately $10.00 per month in
electrical usage.

25. Plaintiff's consumed $2,221.61 worth of electricity for which they are responsible.
This amount represents 12 months at an average of $10.00 per month for the
foreign load adjusted off of the total electrical bill for the unit.
26. Defendant avers that damages to the property, totaling $1,277 .28, were
necessarily repaired in the unit occupied by the Plaintiff's following their vacation
of the property. (See attachment A.)
27. Defendant notified Plaintiff's of said damages in a timely manner and in sufficient
detail to justify an award of the expenses.
WHEREFORE the Defendants demand Judgment against the Plaintiff's in the
amount of $3,498.89 plus costs associated with this action. This sum falls below the
$25,000.00 jurisdictional amount.

COMES NOW, Scott Finkenbinder and Stephanie Finkenbinder who do hereby respond to the
Defendant's New Matter as follows:
23. Denied, It is specifically denied that the Plaintiffs consumed a total of $2,341,61 in electricity from
PP&L during the term of their lease. By way of further answer, it is impossible to specifically determine
the amount of electricity consumed by the Plaintiff's as a foreign load was in existence upon their electircal
system for the period of time they occupied the premises.
24. Denied. The Plaintiffs are without knowledge or information sufficient to form a belief as to the
truth of the matter asserted by the Defendant and they demand strict proof thereof at trial.
25, Denied. The Defendant's calculation is based upon an assumption that must be proven, that is, that
the total amount of electricity generated by the foreign load upon the primary residence was $10.00 per
month,
26, Denied. The Plaintiffs deny that any damages that they may have caused to the property required
43 hours oflabor. By way of further answer, Plaintiffs have evidence that demonstrates that much of the
work that was allegedly preformed by the Defendant to repair the premises was work that was required prior
to the Plaintiff's occupancy of the premises.
27. Neither Admitted nor Denied. The Defendant's averment is a legal conclusion to which no
responsive pleading is required.
